Call to order The meeting was called to order by Vice Chair David Greenwell at 10:00 A.M., in the Meeting Room, Department of Liquor Control, Vilest Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawaii. Takase: Mr. Chairman, before we go to the public hearings I wanted to set the dates for the next Commission meetings, because it will affect where our public hearings are going to be. As those of you who attended the Hilo meeting know, the Hilo Lagoon, where we are located, is under construction so we have to enter from the sides and our parking (situation) is bad. At the last Commission meeting, it was decided to hold our meetings in West Hawaii until construction is completed. I think it was decided for this and the next meeting only. We checked with the building crew and the are still projecting to go into June, so I propose that for April, May Y and June we should plan on having our meetings here (West Hawaii). The reason I needed to know ahead of time is because as we post our agendas, we have to figure out where our public hearings are going to be; as you will see when we get to the Preliminary Hearings when we MARCH 7, 2019 - LIQUOR COMMISSION MINUTES 2 announce where the Public Hearings are going to be. I will ask the Commission to make a motion to decide where the next three meetings will be. Masuda: Mr. chairman, the appropriate motion would be to have the April, May and June meetings of the Liquor commission held at the Vilest Hawaii civic center. Hughes: So moved. Raymond: Second. Mr. Hughes moved that the April, May, and June meetings of the Liquor Commission will be held at the West Hawaii Civic center in Kailua-Kona, Hawaii; seconded by Ms. Raymond. Greenwell: Dorsi, what is the date of the June meeting? Do you know off -hand? Takase: It's the first Thursday, June 6, 2019. Greenwell: We have a motion and a second to hold the Liquor commission meetings for the next three months, April 4th, May 2nd, and June 0th here in West Hawaii, Kona. Is there any discussion? Can you describe your business? Hatch: It's going to be a small craft beer and wine bar and we'll serve pupus and tapas style (food) out of a cold kitchen. That's pretty much it in a nutshell. Greenwell: Director, are there any protests? Takase: Mr. Chairman, the applicant mailed notices out to nine out of nine owners within 'loo feet, 54 out of 58 within 500 feet. There were 50 properties entitled to protest and there were no protests to this application. Greenwell: Commissioners, any discussion or questions? Terrence Lee, Esq., on behalf of the applicant, was present. Greenwell: Will the applicant please come forward and identify themselves and their relationship to the business? Lee: Good morning, Mr. Chair, commissioners. Terry Lee on behalf of the applicants. The reason for this transfer is because both of those entities are commonly owned by craft Brew Alliance which is a publicly traded company out of Portland, Oregon. It owns various craft breweries including Kona Brewing and part of the business that they own through Kona Brewing company is the Kona Brewing restaurant nearby. For corporate reasons to simplify administrative matters, they decided to merge Kona Brewing company into Kona Brewery LLC. Lee: By operation of law whenever a merger occurs, all of the assets and liabilities automatically transfer to the surviving entity, which would be Kona Brewery LLC. Hence, the liquor license ends up being transferred by operational law to the surviving entity. Therefore, we're appearing before this body to seek your approval to that transfer. Greenwell: Have you read the report? Lee: I have read the report and there are no changes. Greenwell: You've already described the business quite well. Is there anymore you'd like to add to that? Lee: No. I will be appearing next month again because we are going to seek a change in class for the license from a Dispenser General and a wholesale brewery license to a small craft brewery. Greenwell: Director, are there any reports of protests? Takase: Mr. Chairman, this is a sale and transfer. There were no written notices but publication was made and there were no protests to this application. Greenwell: Is there any public testimony? There was no public testimony. MARCH 7, 2019 - LIQUOR COMMISSION MINUTES 9 VII. Unfinished Business (10:15 A.M.) Greenwell: Big Island Distillers Inc., dba Big Island Distillers, pursuant to Rule 4-2-M of the Rules and Regulations of the Liquor Commission of the Department of Liquor Control of the County of Hawaii, State of Hawaii, requests approval to extend the time issuance of its Small Craft Producer Pub liquor license, Category A, for an additional six months from January 4, 2019, to and including July 4, 20199 by email dated January 11, 2019. This item was on the February 7, 2019, agenda under New Business. The matter was deferred to March 7, 2019, in order to have the applicant present and to hear the recommendation of the Department. Greenwell: The applicant is being called forward. Please identify yourself and your relationship to the business. Puckett: I'm Dave Puckett, owner of Big Island Distillers Incorporated and I'm here to start my discussion off by apologizing for not asking for the extension. I was a little confused about the dates. I did call one time in November to try and get an update and the Building Department took a long time to ok my blueprints. That's why it's been this long and since then, I've gotten the blueprints and I've passed three of the preliminary inspections so far. I'm moving forward with the construction of the one wall in the space that took ten months for the Building Department to ok. Greenwell: At this time I'd like to ask Gerald to interject. Takase: Yes, Mr. Chairman and members of the Commission, the Department tries to work with all of our applicants and Mr. Puckett has been here for a while and waiting. In his case, believe he applied with Building (Department) in May. Puckett: Yes, May was the first set of prints to the Planning Department that took a month. In June the Building Department got the permits. The first review was sent out on the 15th of June, I'm sorry, that's when they got to Building. Seven fifteen (July 15) was the first review by the Fire Marshal. Seven eighteen (July 18), the second review was completed by the Building Department. Three months later still no contact from the Fire Department on this second review. It just took a long time for them to get the blueprints. They work on Fire Department hours and the Building Department works on general office hours and once one Fire Marshal gets a set of blueprints, nobody else can comment, explain or anything else to my disbelief that they don't act as one department. So I could never find the Fire Marshal that was in charge of my review. We tried daily to find him down here at the Building Department and finally he responded to an email and then we were able to kind of move forward with it. He was very vague in his comments as to what I needed to. do and I had to, just short of purchasing an NFPA manual for a few hundred dollars, I had to delve into it myself to figure out what codes he was talking about. All he wanted was a monitored fire alarm system and an access box on the outside, but he couldn't just say that in plain letters. Takase: I don't know what has happened. Fire Inspectors have moved to an evening schedule. Somehow it's not meshing well with the rest of the approval process, but Mr. Puckett MARCH 7, 2019 -- LIQUOR COMMISSION MINUTES 10 has been in contact with our office. We are going to revamp our procedures and ask Stacie to try and notify all of our applicants that are coming up on their one-year deadline prior to the deadline. Gail who was our previous Licensing officer, was trying to do it ahead of time but a lot of times it didn't come up until the one-year was triggered which is what happened in this case. When Stacie notified him, he sent... Puckett: I still hadn't been given my building permit until January 30th of this year. Takase: Yes, but we notified him on the 1 oth and on the 11 th, he did submit an application for extension. From our side we will try to be more timely, but we believe that there is sufficient room in our rules to allow for the extension to go forward. Undoubtedly, he has good cause and that's typically the reason that most of our applicants need to come back because they are stuck in the middle of the process. I am aware that previous Commissions have questioned why we were involved in that process. We are looking at that as well, but be it as it may, we feel that there is good cause and we recommend the extension be granted to Mr. Puckett and I believe he's finally seeing some movement on his side. We want him to succeed as well and we're getting there. We recommend the extension. Greenwell: okay great, Gerald. Room for improvement. Seeing as there is no public testimony, can we move on to the Commission for discussion and questions? lbarra: I have discussion, Mr. Chairman. At the last hearing, one of the issues was the deadline for applying for an extension. With what you just mentioned about Building (delays and things like that), it seems that you have substantive grounds, if applied timely, that would allow for an extension. What I believe the Commission was initially concerned about, was the eight days. Given your reasons, you could have applied and gotten the extension. I think though we all agree having heard from the Director and you. Puckett: Yes, and that's why I wanted to start off by apologizing for not... lbarra: The eight days is eight days, and I just want to make sure that the Director is going to look into it, like the Chair said. I have no qualms with that, Mr. Chair, but at least we brought out our concern. Greenwell: Thank you, Commissioner. At this time I'd like to call on guidance from Mr. Craig Masuda. Masuda: Thank you, Mr. Chairman. As Commissioner lbarra has stated, it did come in late, however, if you look at the last line of Rule 4-2-M which is talking about the extensions, it says, `Thereafter, an approval of the application may be cancelled and the applicant may be required to reapply for a new license.' The reason I bring this up is that sentence already presumes that the time period has passed already, because it says, '...may be cancelled...' There is, while it's not specifically stated, a strong presumption for an allowance for an extension after the deadline has passed. That's one point I wanted to bring up. MARCH 7, 2019 - LIQUOR COMMISSION MINUTES 11 Masuda: The other point I wanted to bring up is that when it says, `...approval of the application may be cancelled...' last time I erroneously told you folks that the applicant would have to wait a year if the plication at this point was denied. That statement that it s being denied is correct. If Y p the application is denied or rejected, they have to watt a year. But in the case of not granting an extension, the full application didn't even come before us yet, so there is no denial. It's just a cancellation so they don't have to wait a full year. Takase: The section that he was referring to talks about when an application is denied by the Commission, then they are prohibited from coming back, really anybody is prohibited from coming back for another year. But in this case, it's really not the case because he was approved for a license so it doesn't create this prohibition on anybody else. Craig brought that to our attention, and I told him that's talking about a denial by the commission. This was not a denial. Even if you deny his extension, it would just be a cancellation of the license. There was nothing wrong with the citing and that denial language is talking about when we get applicants that come in and get denied. It is to prevent them from repeatedly coming back every month, creating a problem for us as well as for the surrounding neighbors. That is not the case here. Masuda: Yes. Denial is the case where you have a full on hearing with the full on publication and all of that. That's not this case here. This is a cancellation vs. a denial. But, as I said before, the language of the extension portion of the rule is very permissive. Greenwell: commissioners, any more questions or discussion on this subject? Greenwell: Hearing none, I'd like to have a motion to approve or deny the extension of time, finding of good cause, the issuance of the Small Craft Producer Pub liquor license, Category A, for an additional six months from January 4, 2019, to and including July 4, 2019. Mr. Arakaki moved that the Commission finds goods cause to extend and approves the request submitted by Big Island Distillers Inc., dba Big Island Distillers, to extend the time issuance of its Small Craft Producer Pub liquor license, Category A, for an additional six months from January 4, 2019, to and including July 4, 2019; seconded by Mr. Hughes. I had a second, is there any discussion on this motion? lbarra: Mr. Chair, given the applicant was in contact with the Director, given the reasons that the applicant stated why he wants an extension, I'm going to vote in favor of the motion.
