<br />PLANNING COMMISSION <br />COUNTY OF HAWAII <br />HEARING TRANSCRIPT <br />JANUARY 21, 2005 <br />A regularly advertised hearing on the application of <br />STEVE HOLMES (SMA 04-008) <br />was called to order at 10:00 a.m. in the King Kamehameha's Kona Beach Hotel, <br />Kamakahonu Ballroom, 75-5660 Palani Road, Kailua-Kona, Hawaii, with First Vice- <br />Chairperson Hannah Springer. <br />PRESENT:William GrahamABSENT & EXCUSED: Fred Galdones <br />Jeffrey McCallC. Kimo Alameda <br />ReneSiracusaEarlFujikawa <br />Francis Smith <br />Hannah Springer <br />Ivan Torigoe, Deputy Corporation Counsel <br />Roy Takemoto, Deputy Planning Director <br />Norman Hayashi, Program Manager <br />Phyllis Fujimoto, Staff Planner <br />Jeff Darrow, Staff Planner <br />Kiran Emler representing Department of Public Works <br />And approximately 10 people from the public in attendance <br />APPLICANT: STEVE HOLMES (SMA 04-008) <br />Special Management Area (SMA) Use Permit to allow the conversion of a single family <br />dwelling into a 3-unit multiple family residential structure and related improvements. <br />The 5,419-square foot property is located 230 feet east (mauka) of Alii Drive and <br />Kahaluu Beach Park, Kahaluu Beach Lots, North Kona, Hawaii, TMK: 7-8-14:41. <br />SPRINGER:This application was heard by the Hawai i County Planning <br />nd <br />Commission on December 2. The previous vote was 3 2. At this time Id like to <br />invite Mr. Torigoe to give us some background and guidance on how to proceed with this <br />matter. <br />TORIGOE:Thank you, Madam Chairman. Id just like to refer you briefly to <br />the Planning Commission rule 9-11, D-1, which is on page 9-13 of the rules. It actually <br />starts on 9-12 but, basically, this rule states some time limits, that is within 30 calendar <br />days after the conclusion of the hearing or a longer period that may be agreed to by the <br />applicant the Commission shall render a decision. If the Commission fails to render a <br />decision to approve or deny within the time limit, then the rule says that the request shall <br />beconsidereddenied.Theapplicantmayalsorequesttheauthoritytodeferactiononthe <br /> <br />
