Silber (PL-SSP-2022-000016) <br />Dear Planning Commissioners, <br />I live at 13-6553 Kalapana-Kapoho. I apologize for the last minute comment, but I was unaware that the issue was <br />open for comment. <br />My personal contacts with Mr. Silbert have been brief. He was extremely helpful during the Iselle impact. But my <br />background was a licensing investigator for the State of Mexico and the pdf. from planning I had been forwarded <br />left several questions: <br />• Buildings to code. Is there assurance that those responsible will secure a certificate of occupancy before any <br />buildings are used for occupancy. I walk the road twice a day with my dog and am aware of various "guests" <br />entering and leaving the Lolia premises even though a Notice of Violation was filed. How can we be assured this <br />violation will not continue, <br />Responsibility. What is proposed is lodging for multiple individuals. Will there be an architect and project <br />manager on record to assure that all buildings are code -compliant and certificates of occupancy have been <br />issued. Additionally, who is the owner and or responsible party: is it Mr. Silber or a "woman director" <br />• Adequate inspections. I am aware that in the past inspections have been thwarted by closed gate/no <br />response. Can once again violations continue because officials cannot enter the premises. <br />• No events. The pdf. states no festivals, weddings, etc. On what grounds can the county deny special permits if <br />and when building is completed. Again, walking my dog twice a day I am aware that this section of county Hwy <br />137 is one -lane with no adequate side allowance for walkers or bicycle riders. Anyone who lives in the area is <br />familiar with the non-resident traffic and trash created by Seaview lawn Sundays and Kalani erotic dancing and <br />those are areas that are technically two-lane. <br />• Emergency entrance. While the pdf. calls for an additional fire access, it should be considered that we live in an <br />area of multiple hazard potentials. Is there provision, for example for CERT teams to contact guests or arrange <br />evacuation of anyone needing assistance. <br />• Finally, while 1 regret this late filing, I wonder about the fact that no signs of Special Use Application were ever <br />posted at the entrance for any nearby residents to be aware of. Unfortunately, those of us as nearby residents <br />were never aware of this proceeding. <br />While I am aware of the need for the jobs and revenue that can be generated by lodging, I also am aware that an <br />accident that can be contributed to faulty building standards and inspection can drastically impact other owners who <br />offer lodging in the area.
