McIntyre PhD and Cam McIntyre MD <br />54-278 Honopueo Road <br />Kapa'au, HI <br />RE: Public Testimony for AHU POHAKU HOOMALUHIA LLC Application for amendments fo <br />Special Management Area #417 and Amendment to Special Use Permit #1117 <br />Date: 1 /2/2023 <br />This email is to give public testimony to the Leeward Planning Commisioners - asking them to <br />strongly REFUSE the application for amendments to SPA #417 and SUP #1117 due to the enormous <br />burden their retreat expansion from 16 to 36 hotel rooms will have on increased road use on the <br />current, unsafe, 1/2 mile private Maluhia Road connecting Akoni Pule Highway to Pratt Rd and Lokahi <br />Road. The construction and maintenance of Maluhia Road by Ahu Pohaku Hoomaluhia LLC created <br />years of litigation and has been problematic for seventeen TMKs surrounding lots due to non- <br />compliance of the LLC's Hawaiian Retreat Center not adhering to their special use permit. (see <br />attached pictures of blind curves and culvert at the bottom on Maluhia) <br />In their Special Use permit #1117 it states the Maluhia road should be 20 ft wide. The pavement is <br />only 15 feet wide ... and the remaining 5 ft was to be maintained by the commercial retreat - AHU <br />POHAKU HOOMALUHIA. This has not happened. The road is unsafe, steep, with poor signage and <br />lots of water lines on the easements. <br />Special Use permit #1117 requires an insurance policy for liability for Maluhia and public access to <br />shoreline. Only recently a public access sign has gone up due to the proposed sale of AHU POHAKU <br />HOOMALUHIA - retreat center for an approximately 15 million dollar price tag which is still in <br />negotiation with Hawaii Life Reality. Given a proposed sale the owners need hotel room expansion on <br />the 5 acres they are carving out for sale at this price. The Hawaiian Retreat Center as a commercial <br />venture and has only Maluhia Road to access their hotel from the highway ... they need to bear the <br />cost of maintaining this road for commercial use. Maluhia Road would be much safer if the county <br />would provide oversite on their special use permit #1117 which requires AHU POHAKU <br />HOOMALUHIA to maintain/mow the sides of the Maluhia Road. <br />1 <br />
