RKonaAerial.j ma.revisedcond.9.15.21 <br /> KONA AERIAL GYMNASTIC TEAM INC. <br /> SPECIAL PERMIT APPLICATION (SPP 21-000227) <br /> REVISED RECOMMENDATION AND CONDITIONS OF APPROVAL <br /> The Deputy Director Ends it prudent to revise the conditions of approval, in order to clarify <br /> timing. <br /> The Deputy Planning Director recommends revising the following conditions: <br /> 5. Prior to applying for a building permit, the applicant shall secure Final Plan <br /> Approval for the proposed development from the Planning Director in accordance <br /> with Section 25-2-70, Chapter 25 (Zoning Code), Hawaii County Code. Plans <br /> shall identify all existing and proposed structures, fences, signage, water sources <br /> (potable and non-potable), wastewater systems, fire protection measures, paved <br /> driveway access and paved parking stalls, outdoor lighting (if any, lighting must <br /> be shielded with light directed downwards), landscaping and other improvements <br /> associated with the proposed development. <br /> 10. Within five (5) years from the effective date of this permit, the applicant shall <br /> align the access driveway within the 60-foot wide future Kakalina Road extension <br /> alignment. This alignment shall be noted on all future plans submitted to the <br /> County and shall be kept clear of any permanent structures. <br /> 17. With the exception of condition No. 10, an initial extension of time for the <br /> performance of conditions within the permit may be granted by the Planning <br /> Director upon the following circumstances: <br /> A. The non-performance is the result of conditions that could not have been <br /> foreseen or are beyond the control of the applicant, successors or assigns, <br /> and that are not the result of their fault or negligence. <br /> B. Granting of the time extension would not be contrary to the General Plan <br /> or Zoning Code. <br /> C. Granting of the time extension would not be contrary to the original <br /> reasons for the granting of the permit. <br />
