RSchmitzREZ.5/11/23 <br /> COUNTY OF HAWAPI PLANNING DEPARTMENT <br /> RECOMMENDATION <br /> DENNIS SCHMITZ <br /> CHANGE OF ZONE APPLICATION (PL-REZ-2023-000041) <br /> Upon careful review of the request against the guidelines for granting a change of zone,the <br /> Planning Director is recommending that a favorable recommendation for a Change of Zone from <br /> Agricultural 20-acre(A-20a)to Agricultural 5-acre(A-5a)for approximately 20.027 acres be <br /> forwarded to the County Council. Since this recommendation is made without the benefit of <br /> public testimony, the Planning Director reserves the right to modify and/or alter this <br /> recommendation based upon additional information presented at the public hearing. This favorable <br /> recommendation is based on the following findings: <br /> The applicant is requesting a Change of Zone from Agricultural (A-20a) zoning <br /> district to Agricultural (A-5a) zoning district for 20.027 acres of land in order to subdivide <br /> the property into four (4) lots, each approximately 5 acres in size. The applicant plans to <br /> retain one (1) lot and sell the remaining lots to other family members to allow for more <br /> intense farming by the individual family members. The proposed A-5a zoning would allow <br /> for up to 4 lots to be created on the subject property. According to the Zoning Code, the <br /> Agricultural zoning district provides for agricultural and very low density agriculturally- <br /> based residential use,encompassing rural areas of good to marginal agricultural and grazing <br /> land,forest land,game habitats,and areas where urbanization is not found to be appropriate. <br /> According to the applicant, a subdivision application would be filed within a year <br /> from the granting of the Change of Zone. The applicant anticipates having the property <br /> subdivided within 3 years at a cost of somewhere around $200,000. The applicant has also <br /> filed a concurrent SMA Use Permit application for the proposed 4-lot subdivision. <br /> In order to consider an area for any type of zoning designation,the applicable goals, <br /> policies and standards of the General Plan must be adequately addressed. It is only through <br /> such a comprehensive policy analysis approach that evaluations and decisions can be made <br /> to better time and stage developments to achieve growth consistent with the General Plan <br /> and related planning documents.
