PL-SPP-2023-000037 <br /> AMENDED BACKGROUND AND RECOMMENDATION & NEW CONDITION <br /> On June 6, 2023, the Department of Land and Natural Resources-State Historic Preservation <br /> Division (SHPD) sent an email requesting that the applicant submit an Archaeological Inventory <br /> Survey (AIS) in support of the proposed project(see Exhibit 13 attached). <br /> The existing background and recommendation reports incorrectly state that the Planning <br /> Department had not received comments on the project from SHPD, so this document is intended <br /> to amend those reports as follows: <br /> Background Report(Section 20. Archaeological Resources): <br /> Replace, "but neither the applicant nor the Planning Department received a response at the time <br /> of this writing."with"who requested that the applicant submit an Archaeological Inventory <br /> Survey (AIS) in support of the proposed project." <br /> Recommendation Report(Under the "Ka Pa`akai O Ka`Aina" analysis starting on Page 10) <br /> Under"Possible adverse effect or impairment of valued resources:" at the top of Page 11, <br /> replace, "However, if future development plans of the education center propose new ground <br /> disturbance in the vicinity of the wall remnant, further archaeological assessments should be <br /> completed and approved prior to commencement."with"However, SHPD has requested that the <br /> applicant submit an Archaeological Inventory Survey (AIS) in support of the project." <br /> Under"Feasible actions to protect native Hawaiian rights:" on Page 11, replace, "A condition of <br /> approval will require the applicant to secure SHPD approval prior to issuance of any land <br /> alteration permits should the applicant propose any ground disturbance in the vicinity of the rock <br /> wall in the future."with, "A condition of approval will require the applicant to secure SHPD <br /> approval prior to issuance of Final Plan Approval for the proposed project." <br /> Finally, the Director recommends replacing Condition 12 on Page 13 with the following: <br /> 12. Prior to the issuance of Final Plan Approval, the Applicant shall secure final approval <br /> under HRS Chapter 6E-42 from the Department of Land and Natural Resources-State <br /> Historic Preservation Division (DLNR-SHPD). <br /> As the applicant is not proposing any land alteration for the project, the Director is comfortable <br /> conditioning final SHPD approval prior to the Planning Department issuing Final Plan Approval, <br /> which will be required as the first step to the development process. This will allow the Planning <br /> Department to track compliance with this approval and ensure that any mitigation, if required, is <br /> completed prior to development and operation. <br />
