PD Amended Background & Recommendation Report & New Condition No. 12

PL-SPP-2023-000037 AMENDED BACKGROUND AND RECOMMENDATION & NEW CONDITION On June 6, 2023, the Department of Land and Natural Resources-State Historic Preservation Division (SHPD) sent an email requesting that the applicant submit an Archaeological Inventory Survey (AIS) in support of the proposed project(see Exhibit 13 attached). The existing background and recommendation reports incorrectly state that the Planning Department had not received comments on the project from SHPD, so this document is intended to amend those reports as follows: Background Report(Section 20. Archaeological Resources): Replace, "but neither the applicant nor the Planning Department received a response at the time of this writing."with"who requested that the applicant submit an Archaeological Inventory Survey (AIS) in support of the proposed project." Recommendation Report(Under the "Ka Pa`akai O Ka`Aina" analysis starting on Page 10) Under"Possible adverse effect or impairment of valued resources:" at the top of Page 11, replace, "However, if future development plans of the education center propose new ground disturbance in the vicinity of the wall remnant, further archaeological assessments should be completed and approved prior to commencement."with"However, SHPD has requested that the applicant submit an Archaeological Inventory Survey (AIS) in support of the project." Under"Feasible actions to protect native Hawaiian rights:" on Page 11, replace, "A condition of approval will require the applicant to secure SHPD approval prior to issuance of any land alteration permits should the applicant propose any ground disturbance in the vicinity of the rock wall in the future."with, "A condition of approval will require the applicant to secure SHPD approval prior to issuance of Final Plan Approval for the proposed project." Finally, the Director recommends replacing Condition 12 on Page 13 with the following: 12. Prior to the issuance of Final Plan Approval, the Applicant shall secure final approval under HRS Chapter 6E-42 from the Department of Land and Natural Resources-State Historic Preservation Division (DLNR-SHPD). As the applicant is not proposing any land alteration for the project, the Director is comfortable conditioning final SHPD approval prior to the Planning Department issuing Final Plan Approval, which will be required as the first step to the development process. This will allow the Planning Department to track compliance with this approval and ensure that any mitigation, if required, is completed prior to development and operation.
