From: Debra Rodriguez <br /> To: LPCtestimonv <br /> Subject: Special Permit case number PL-SPP-2023-000045 <br /> Date: Monday,August 14,2023 3:20:42 PM <br /> We oppose the application of Special Permit, case number PL-SPP-2023-000045. <br /> Dear Planning Department, <br /> We are registering our objection to the above applicants request for a Special Use Permit for a STVR <br /> application by them for a STVR is in conflict with Section A and Section I of the Restrictive Covenants <br /> of Keopu Heights Subdivision, said restrictive covenants running with the land. <br /> Section A: Resident Purpose. All subdivision lots and every portion thereof shall be used on <br /> for private residence purposes, including private garage and other similar purposes <br /> reasonably necessary in connection with such private residence and for no other purpose. <br /> Section 1: Business or Offensive Uses: No retail or wholesale shop or store shall be erected <br /> or any business, industry, obnoxious or offensive trade shall be carried upon any subdivision lot or <br /> be done thereon which may be or become an annoyance or nuisance to other subdivision lots. <br /> We have lived in this quiet subdivision of single family homes for 23+years. Ihona Street which the <br /> property of the Applicants is on a private road consisting of 6 lots. The only method available to <br /> reach the Applicants property is to use Hiona Street (County Road). Granting a STVR will increase <br /> traffic, noise, etc, on Hiona Street (the street where we reside). Further Hiona Street is not a <br /> thoroughfare and as constructed its 21%grade has in the past already proved hazardous for <br /> commercial and private vehicles (brake failures, runaway, accidents). More traffic, potentially more <br /> bad outcomes. <br /> We respectfully ask the Planning Department to not disregard the Restrictive Covenants of the <br /> Keopu Heights when making their decision. If this special permit is accepted by the County other <br /> home owners may very well be induced to start a STVR in the subdivision thereby adding more <br /> undesired vehicular traffic and noise etc, as well as lowering property values. <br /> Sincerely, <br /> Debra S & Lewis V Rodriguez <br /> 75-805 Hiona Street <br /> Holualoa, HI 96725-9601 <br />
