BR-CClnitiated-B&BRepeal.doc 2/19/2023 <br /> COUNTY OF HAWAI`I PLANNING DEPARTMENT <br /> BACKGROUND AND RECOMMENDATION <br /> COUNTY COUNCIL INITIATED BILL NO. 122 (PL-CCI-2024-000004) <br /> AMENDMENT TO CHAPTER 25 AND CHAPTER 14,ARTICLE 4, SECTION <br /> 14-20, OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION,AS <br /> AMENDED),RELATING TO THE REPEAL OF BED AND BREAKFAST AS A <br /> PERMITTED USE <br /> The County Council has referred Bill No. 122 to the Planning Director and the Windward <br /> and Leeward Planning Commissions for comments and recommendations. <br /> PURPOSE OF BILL NO. 122 <br /> 1. The Hawaii County Council has introduced Bill No. 122 (Planning Department <br /> Exhibit 1),which seeks to amend Chapter 25 (Zoning Code) and Chapter 14 <br /> (General Welfare), Article 4, Section 14-20 of the Hawaii County Code 1983 <br /> (2016 edition, as amended), relating to the repeal of bed and breakfast(B&B). <br /> 2. The purpose of this amendment is to repeal all provisions that allow for bed and <br /> breakfast establishments as it will be regulated as either an Owner-hosted or <br /> Operator-hosted transient accommodation rental, should County Council-initiated <br /> Bill 121 (Transient Accomodation Rentals)be adopted. <br /> WHAT IS A B&B? <br /> 3. A B&B is currently defined as any single family dwelling and/or guest house <br /> (pursuant to HCC section 25-4-9), which have been permitted on a building site, <br /> in which overnight accommodations and only breakfast meals are provided to a <br /> maximum of ten guests, for compensation, for periods of less than 30 days. The <br /> bed and breakfast establishment shall be subordinate and clearly incidental to the <br /> principal use as a residence by its operator and not alter or be detrimental to the <br /> character of the surrounding area. The operator of the bed and breakfast <br /> establishment shall reside on the same building site as that being used for the bed <br /> and breakfast establishment. <br /> WHERE ARE B&Bs CURRENTLY PERMITTED? <br /> 4. Bed and breakfast are currently permitted in the following zoning districts: <br /> • Double Family Residential (RD) zoning district; <br /> • Multiple-Family Residential (RM) zoning district; <br /> -1- <br />
