<br />PLANNING COMMISSION <br />COUNTY OF HAWAI‘I <br /> <br />HEARING TRANSCRIPT <br />MAY 3, 2012 <br /> <br />JOHN HEGARTY (SPP 12-132) <br />A regularly advertised hearing on the application of was called to order at <br />9:16 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with <br />Chairman Zendo Kern presiding. <br /> <br />COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Ronald Gonzales, Wallace Ishibashi, and Raylene <br />Moses <br /> <br />STAFF PRESENT: Molly Lugo (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director), Daryn <br />Arai (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Maija Cottle (Staff Planner), Jeff Darrow <br />(Staff Planner), Sarah Hata-Finley, (Staff Member) and Sharon Nomura (Secretary) <br /> <br />ABSENT AND EXCUSED: Stephen Ono <br /> <br />APPLICANT: JOHN HEGARTY (SPP 12-132) <br />Application for a Special Permit to allow the establishment of a convenience store with a certified kitchen on <br />two properties covering a total of 4.64 acres of land within the State Land Use Agricultural District. The <br />th <br />properties are located at the southwestern corner of the Ainaloa Boulevard-37 Avenue intersection in <br />Orchidland Estates Subdivision, directly across the Ainaloa Longhouse complex, Kea‘au, Hawai‘i, TMK: 1-6- <br />008: 240 & 141. <br /> <br />KERN: Application No. 2, John Hegarty (SPP 12-132), application for a Special Permit to allow the <br />establishment of a convenience store with a certified kitchen on two properties covering a total of 4.64 acres of <br />land within the State Land Use Agricultural District off of Ainaloa Boulevard in Orchidland Estates <br />Subdivision, on TMK: 1-6-008: 240 & 241. With that we’ll go to staff presentation, Maija. <br /> <br />COTTLE: Thank you, Mr. Chair. Good morning, Commissioners. <br /> <br />COMMISSIONERS: Good morning. <br /> <br />COTTLE: The next application is a special permit request and the subject property is located in the Puna <br />district in the Orchidland Estates Subdivision. It actually borders the Ainaloa Subdivision as well. You can see <br />the property shown on the slide outlined in red. And we have the Keaau-Pahoa Road running in a north/south <br />direction in the middle of the slide. And then you can see Ainaloa Boulevard coming off of the highway here. <br />th <br />The subject property is located in this area. And this is a close-up view. Again, Ainaloa Boulevard and 37 <br />Avenue fronts the property as well. This is an aerial view of the property. <br /> <br />Oh, you know what, let me go back to zoning. I skipped that. The property is zoned Agricultural 1-acre which <br />is shown in light green, and most of the properties surrounding it are zoned Agricultural - 1 acre as well. The <br />Ainaloa Longhouse which is a community facility is located directly across Ainaloa Boulevard in this area of <br />dark green which is zoned Open. This is an aerial view of the property. It actually consists of two lots, side by <br />th <br />side; and you can see 37 Avenue here, and then Ainaloa Boulevard again running in like an east-west direction. <br />This is the Ainaloa Longhouse across the street. They also have a mailbox area for the subdivision here. There <br />is a volunteer fire station, and then a park and playfield in the back.
