RRTServiceA1nendSPP1247 9/30/21 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> RECOMMENDATION <br /> RT'S SERVICE, LLC <br /> AMENDMENT TO SPECIAL PERMIT NO. 1247 (SPP 1247) PL-SPP-2021-000001 <br /> Upon review of the request against the guidelines under Rule 6 of the Planning <br /> Commission Rules of Practice and Procedures for granting an amendment to Special Permits, the <br /> Planning Director recommends this amendment request be approved by the Planning <br /> Commission. Since this recommendation is made without the benefit of public testimony, the <br /> Director reserves the right to modify and/or alter this recommendation based upon additional <br /> information presented at the public hearing. This recommendation is based on the following <br /> findings: <br /> Special Permit No. 1247 (SPP 1247)was issued in 2004 to allow office and <br /> storage uses for investigative/collection services, a towing service, and short-term <br /> parking for repossessed or disabled vehicles on an approximately 14,273-square foot <br /> portion of a 5.006-acre parcel in the State Land Use Agricultural District. The permit was <br /> amended in 2017 to expand the permit area from 14,273-square feet to 1.647 acres. The <br /> applicant has requested the following amendments to SPP 1247: 1) amend Condition <br /> number 3 so that the life of the permit runs with the current owner; 2) amend Condition <br /> number 6 to provide an additional two years to complete building permits; and 3) amend <br /> Condition number 7 to extend the hours of operation for the Inspection Station. <br /> The previous owner, David McCollough, Trust, has conveyed the legal title to the <br /> property to David McCollough, John Roth, Mark Farias and Dianna Farias. The change <br /> in ownership is documented by the Trustee's Limited Warranty Deed, dated February 7, <br /> 2020, recorded in the Bureau of Conveyances of the State of Hawaii in Document No. A- <br /> 73450693. David McCollough continues to be a current owner of the subject property <br /> and is the sole managing member of RT's Service, LLC, the operator of the facility. As <br /> such, the applicant proposes to amend Condition No. 3 to reflect the change in <br /> ownership. <br /> In 2018, the applicant began the process of securing a building permit for the <br /> existing shop structure and the existing prefabricated office trailer.
