NOTICE OF PUBLIC MEETING AND HEARINGS PLANNING COMMISSION COUNTY OF HAWAII NOTICE IS HEREBY GIVEN of the following matters to be considered by the Planning Commission of the County of Hawaii in accordance with the provisions of Chapters 91 and 92, Hawaii Revised Statutes, Section 6-4.3 of the Charter of the County of Hawaii, and the Planning Commission’s Rules of Practice and Procedure. DATE: Friday, February 22, 2008 TIME: 9:00 a.m. PLACE: Waikoloa Beach Marriott Hotel - 69275 Waikoloa Drive Waikoloa, Hawaii NEW BUSINESS – 9:00 a.m. APPLICANT: EDWIN DELUZ TRUCKING AND GRAVEL LLC (SPP 956) 1. Request to amend condition no. 5 (life of permit) of Special Permit No. 956, which allowed the establishment of a quarry for soil mining on 14.9 acres within the State Land Use Agricultural District. The permit was previously issued to Allied Aggregates Ltd. for property located approximately 2.5 miles northeast of the Hawaii Belt Road (Highway 190)-Saddle Road junction in the vicinity of the West Hawaii Concrete quarries at Waikoloa, South Kohala, Hawaii, TMK: 6-7-1: portion of 25. UNFINISHED BUSINESS – 9:30 a.m. INITIATOR: PLANNING DIRECTOR 2. Amendment to Chapter 2, Article 7, Hawaii County Code 1983 (2005 Edition, as amended) relating to the Planning Commission’s review of a draft community development plan or amendment thereof. The purpose of the amendment is to provide a time frame for the Planning Commission’s review and recommendation to the County Council on a draft Community Development Plan or amendment. INITIATOR: PLANNING DIRECTOR 3. Amendment to Chapter 25 (Zoning), Article 2, Division 3, Section 25-2-35, Hawaii County Code 1983 (2005 Edition, as amended) relating to administrative enforcement. The proposed amendment states that “an appeal to the board of appeals shall not stay the provisions of the (planning) director’s order pending the final decision of the board of appeals.”
