BKonaThreeeLLCAmendREZ.crk.11.22.22 <br />COUNTY OF HAWAII PLANNING DEPARTMENT <br />BACKGROUND REPORT <br />KONA THREE LLC (FORMERLY GAMREX, INC.) <br />AMENDMENT TO CHANGE OF ZONE ORDINANCE NO. 02 131 (REZ 470) <br />KONA THREE LLC has submitted an application for a ten (10) -year time extension to <br />Condition I (Complete Construction of the First Increment on RM Zoned lands) and an <br />amendment to Condition N (Roadway Standards) to clarify which roadways within the <br />subdivision are subject to the County Dedicable Standards, of Ordinance No. 02 131. Ordinance <br />No. 02 131 was a successor ordinance to Ordinance No. 84-23, which reclassified two (2) parcels <br />of land totaling 68.837 acres of land from an Unplanned to a Multiple Family Residential -5,000 <br />square feet (RM -5) zoned district. The subject properties are located along the east (mauka) side <br />of the Queen Ka`ahumanu Highway at its junction with Kuakini Highway and between Pualani <br />Estates subdivision to the north and Kona Vistas to the south, por. Holualoa Hui Lands, Holualoa <br />1, 2, & 3, North Kona, Hawai`i, TMKs: (3) 7-6-021:016 & 017. <br />APPLICANT'S REQUEST AND REASONS <br />1. Applicant's Request: The applicant is requesting to amend Condition I and Condition N <br />of Ordnance No. 02 131. <br />Condition I: <br />The applicant initially requested an extension of time of ten (10) years from the effective <br />date of the amended ordinance by which to complete construction of the first <br />increment/phase (258 multiple -family residential units) of the proposed development. As <br />further discussed in section 3 below, the applicant has since clarified the request to a ten <br />(10) -year time extension to complete the entire development. Condition I currently states: <br />"L plans for the development within the first increment of the RM zoned area shall be <br />submitted to the Planning Department and final plan approval secured within five <br />years from the effective date of this sixth amendment.
