Kohala District,Hawaii <br /> This is to notify you of the acceptance of the above-referenced Use Permit Application on March 7, <br /> 2024. <br /> Please be informed, that in accordance with the Planning Commission's Rule 4, Contested Case <br /> Procedure, within ten (10) days after receipt of this letter, you are required to serve notice of your <br /> application on surrounding property owners and lessees of record within 300 feet of the perimeter <br /> boundary of the building site, as required in the Hawaii County Zoning Code, Section 25-2-4. <br /> In accordance with Hawaii County Zoning Code, Chapter 25-2-4(c), in determining the names and <br /> addresses of the affected owners and lessees of record, as required by this section,the applicant shall <br /> utilize the data available from the real property tax office; provided, that where the director has <br /> received written notice of additional or subsequent owners or lessees of record and has so informed <br /> the applicant, the applicant shall also provide the required notice to such persons. The applicant shall <br /> also provide notice to such other owners and lessees of record when the applicant otherwise has <br /> actual knowledge of such other owners or lessees of record. <br /> In addition, upon notice by our department that the hearing date has been set, you are again required <br /> to notify all owners and lessees of record within 300 feet of the perimeter boundary of the building <br /> site.
