From: Diane Ware <br /> To: WPCtestimonv <br /> Subject: Agenda item 1,08/01/24 <br /> Date: Tuesday,July 30,2024 3:55:36 PM <br /> Dear Chair Lin and Commissioners, <br /> The Colony 1 HOA has updated the filing for a contested case in the matter of the SMAA application for Black <br /> Sands Beach development at Punalu'u.Mr.Silva has qualifications with water and sanitation systems and was <br /> appointed by the board to represent the owners in this matter.The board has provided numerous documents to not <br /> only clear up questions the committee had regarding their standing including the board's February 2024 meeting <br /> minutes but also documents that back up their claims regarding health and safety issues not as yet corrected by the <br /> owner,Ms.Liu,of Punalu'u Water and Sanitation LLC after 4 years of ownership.The engineering report also <br /> states that the current system capacity was downgraded by the HDOH in 2017 to 20,000 g/d from 100,000 g/d.The <br /> downgrade was never reported in the SMAA,only the original capacity. <br /> PWS is a privately owned public utility regulated by the PUC under docket 2018-0408. <br /> In it is included the Aqua Engineering report regarding the condition and lifespan of PWS.In the case of the <br /> wastewater treatment system Aqua Engineers recommends replacing the wastewater facility and upgrading it to R-1 <br /> with a more"eco friendly"system.This recommendation aligns with the proposed system upgrade outlined in the <br /> 2006 DEIS. <br /> I recently spent a week at Colony 1 and witnessed the deficiencies and can say I would also live in fear of fire and <br /> failures in the water and sanitation system.I saw the broken fire hydrants and the pump station just below the <br /> condominiums.The building looks dilapidated with a hole punched in one wall to divert smelly,flowing sewage <br /> into a manhole.It was frightening.Below is my photo taken mid May very similar to the one provided by the HOA. <br /> The hose is a soft material easily perforated and would leak into environment 36'above sea level and close to <br /> ponds.What is going on here?This needs to be corrected and brought up to current standards before any new <br /> development is approved. <br /> ❑— <br /> ❑® <br /> I wholeheartedly encourage you to reconsider the HOA contested case and take steps to protect residents and the <br /> health of nearshore waters and wildlife like honu. <br /> Respectfully, <br /> Diane Ware <br /> 808-967-8642 <br /> P.O.Box 698 <br /> 99-7815 Kapoha <br /> Volcano 11196785 <br />
