<br />PLANNING COMMISSION <br />COUNTY OF HAWAI‘I <br /> <br />HEARING TRANSCRIPT <br />MARCH 1, 2012 <br /> <br />A regularly advertised hearing on the PLANNING DIRECTOR INITIATED AMENDMENT TO CHAPTER 25 <br />(ZONING CODE) OF THE HAWAI‘I COUNTY CODE 1983 (2005 EDITION, AS AMENDED) RELATING <br />TO BED AND BREAKFAST ESTABLISHMENTS, was called to order at 9:57 a.m. in the County of Hawai‘i, <br />Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Zendo Kern presiding. <br /> <br />COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Takashi Domingo, Wallace Ishibashi, Stephen Ono <br />and Raylene Moses <br /> <br />STAFF PRESENT: Ivan Torigoe (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director), <br />Daryn Arai (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Maija Cottle (Staff Planner), Jeff <br />Darrow (Staff Planner), and Sharon Nomura (Secretary) <br /> <br />And eight people from the public in attendance. <br /> <br />APPLICANT: PLANNING DIRECTOR INITIATED <br /> <br />Amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended) <br />relating to bed and breakfast establishments. The proposed amendment will specifically amend Sections 25-2- <br />61(a), 25-2-71(c), 25-2-76(b through e), 25-4-7(a), 25-5-52(d), 25-5-62(d) and 25-5-72(d). This is a <br />housekeeping matter that seeks to provide consistency among different sections of the Zoning Code relating to <br />bed and breakfast establishments. <br /> <br />KERN: Okay, Application No. 5, Amendment to Chapter 25, Hawai‘i County Code, relating to bed and <br />breakfast establishments. That is to be deferred as well? <br /> <br />DARROW: Yes. <br /> <br />KERN: Do you have a time for that? <br /> <br />DARROW: Thank you, Mr. Chairman. The reason for the request for the deferral is that we currently have a <br />bill relating to crematoriums, funeral homes, mortuaries that is in the process of going up to Council and it <br />hasn’t been adopted yet. If that’s adopted it will make a difference to this bill. And so they have asked us to <br />hold off on introducing this bill until that bill passes. So that’s the only reason for the request on the deferral. <br /> <br />KERN: There’s a correlation between funerals and crematoriums to bed and breakfasts? <br /> <br />DARROW: Some of the sections -. Yeah, what happens is like under use permits, a certain section will require <br />a use permit for a B&B, as well as a mortuary. And so those sections will conflict. <br /> <br />KERN: Okay. <br /> <br />DARROW: But there’s no relation. <br /> <br />KERN: And so it’s an open deferral until such time that -? <br /> <br /> 1 <br /> EXHIBIT D <br /> <br /> <br />
