RULES AND REGULATIONS OF THE
DEPARTMENT OF PARKS AND RECREATION
OF THE COUNTY OF HAWAII
RULE 2 - RULES RELATING TO THE HILO MUNICIPAL GOLF COURSE
Section 1 Applicability and Scope
A. These rules and regulations shall apply to the Hilo Municipal Golf Course,
inclusive of ground facilities and structures under the control, management
and operation of the Department of Parks and Recreation, County of
Hawaii.
B. If any provision of these rules and regulations or the application of such
provision is found to be invalid, the remaining portions of these rules and
regulations or the application of said portions shall not be affected.
Section 2 Definitions
Whenever used in these rules and regulations, unless a different meaning is plainly
intended by context:
A. "Citation" shall mean the written certificate issued to a violator of these
rules and regulations which shows the nature of the violation, the date and
time.
B. "Club" shall mean a group of players organized for the purpose of playing
golf on a regular/recurring basis, identified by a unique name, and
registered to play at the golf course.
C. "Concessionaire" shall mean the operators of commercial enterprises at
the golf course under an agreement with the County of Hawaii.
D. "Course" shall mean that portion of the golf course utilized for playing golf.
E. "Department" shall mean the Department of Parks and Recreation, County
of Hawaii.
F. "Director" shall mean the Director of the Department of Parks and
Recreation, County of Hawaii.

G. "Golf Course" shall mean the Hilo Municipal Golf Course, the clubhouse,
practice green and range, structures and parking areas.
H. "Golf Course Administrator" (also referred to as the "Administrator"
hereinafter) shall mean the manager of the golf course or the
Administrator's duly designated representative.
I. "Green Fee" shall mean the fee assessed an individual which entitles
him/her to play one round of golf at the Hilo Municipal Golf Course on the
day for which the fee is paid.
J. "Group" shall mean one (1) or more golfers assigned an identical starting
time on a particular teeing area of the course.
K. "Hawaii Island Resident" shall mean a person who lives and resides
within the County of Hawaii. A valid Hawaii driver's license, valid State-
issued identification card or valid school identification card shall be
accepted forms of proof of Hawaii residency.
L. "Holiday" shall mean all days an which a holiday is observed by the
County of Hawaii regardless of the date of the actual holiday.
M. "Junior" shall mean a Hawaii Island resident, seventeen (17) years old or
younger.
N. "Lesson" shall mean the provision of golf instruction on a fee basis.
0. "Major Violation" shall mean the malicious damage of public property,
violation of maximum grouping of players, willful non-registration and/or
non-payment of fees.
P. "Management" shall mean the Director of Parks and Recreation or the
Director's duly designated representative.
Q. "Marshal" shall mean any authorized golf course personnel patrolling the
course to ensure smooth play and compliance with these rules and
regulations.
R. "Minor Infraction" shall mean the violation of any provision under Section
7, Rules Affecting Players.
S. "Monthly Card Fee" shall mean the fee assessed a golfer which entitles
that golfer to play at the Hilo Municipal Golf Course on any day that the
golf course is open during the month for which the fee is paid, except as
provided herein below

T. "Permit" shall mean a receipt or a current monthly card issued by the
Department.
U. "Permittee" shall mean a person approved to use the multipurpose room.
V. "Person With Disabilities" shall mean with respect to an individual, a
physical or mental impairment which substantially limits one or more major
life activities of such individual, a record of such an impairment or being
regarded as having such an impairment.
W. "Player" shall mean a person who enters the course to play golf.
X. "Professional" shall mean a golf professional who operates the golf pro
shop in agreement with the County of Hawaii.
Y. "Registration" shall mean and consists of signing in, paying of green fees
or presenting a valid permit, and being assigned a starting time prior to
going onto the course to begin play.
Z. "Regular Golfer" shall mean a player who is eighteen (18) years of age or
older and not a student, university student, or a senior citizen.
AA. "Round" shall mean the completion of up to eighteen (18) holes of golf in
numerical sequence, beginning with the first hole or as otherwise
provided.
BB. "Senior Citizen" shall mean a person who has attained sixty (60) years of
age, regardless of employment status.
CC. "Service Animal" shall be defined by the current Americans with
Disabilities Act, Title II and Title III rules.
DD. "Starter" shall mean the County of Hawaii personnel assigned to and
working out of the golf course office.
EE. "Starting Time" shall mean the specific time assigned a group for the start
of play.
FF. "Tournament" shall mean a golf event or competition, other than regular
club play, which requires reserved tee times.
GG. "Tournament Fees" shall mean those fees, in addition to green fees,
assessed the organizers of all tournaments held at the golf course.
HH. "UH Student" shall mean any full-time student currently enrolled at the
University of Hawai'i or a Hawaii resident who is a full-time student

currently enrolled at any accredited college or university.
11. "Weekend and Holiday Green Fees" shall mean the fees assessed an
individual which entitles him/her to play a round of golf at the Hilo
Municipal Golf Course on a weekend day or holiday.
Section 3 Rules Relating to the Hilo Municipal Golf Course
A. Operation of the Golf Course
1. The Hilo Municipal Golf Course shall be open for play every day
with the exception of Christmas Day and New Year's Day and when
climatic, staffing or other unusual circumstances require its closing.
2. The hours of play shall be from 7:00 a.m. to sundown, by which
time all players shall have exited the golf course. All play shall start
no later than 5:00 p.m. The Director or the Director's duly
designated representative may allow early morning play, beginning
no earlier than 6:30 a.m., with proper provision for liability and
registration.
3. The hours of operation for the Starter's Office shall be 6:30 a.m. to
5 p.m. daily.
4. All rented equipment shall be returned by the time determined by
the pro shop concessionaire.
5. In the event of major repair or renovation work to the golf course or
the existence of conditions which substantially limit the normal use
of the golf course, the Director is authorized to adjust the playing
fees charged and the hours of operation.
6. The Administrator shall have the authority to enforce all rules and
regulations and to establish temporary rules and regulations which
are found necessary to protect the course and players. Further, the
Administrator, with the approval of the Director, may establish
internal policies and procedures to ensure operational efficiency of
the golf course.
7. The Director may prohibit any person from playing at the Hilo
Municipal Golf Course when the Director has a reason to believe
that such person poses a threat to the health, safety, or welfare of
persons or property at the golf course or when such person has
previously been cited by the Administrator for a violation of these
rules and regulations, and such citation has not been reversed by
the Director. Any person aggrieved by the decision of the Director

to prohibit such play shall have the right to appeal the Director's
decision within thirty (30) days of such decision pursuant to Rule 1
of the Rules and Regulations of the Department of Parks and
Recreation.
8. No practice golfing shall be allowed on the golf course except the
practice putting green and practice chipping green located adjacent
to the clubhouse.
9. The designated practice putting and chipping areas shall be
reserved for the exclusive use of golfers.
B. Use of the Multipurpose Room
1. The multipurpose room shall be made available for rent by
individuals, groups, organizations, and other members of the public.
a. A use permit is required to reserve the multipurpose room for
exclusive use.
b. Use permits shall be reserved with and purchased from the
Administrator or the Administrator's duly designated
representative.
c. Reservations shall not be accepted or use permits issued for
date(s) when an approved golf tournament is scheduled to
be held.
d. Use permits shall be issued on a first-come, first-served
basis for date(s) when no approved golf tournament has
been scheduled.
e. Use permits may be purchased no more than ninety (90)
calendar days before the first occupancy date stated on the
use permit.
f. Deposits applied and receipted for any use permit shall be
considered forfeited and will not be refunded unless
cancellation is made fourteen (14) or more calendar days
before the first occupancy date stated on the use permit.
2. Capacity shall be limited to 162 persons.
Note: This figure is based on calculations derived from usable floor
area; the Department does not guarantee this capacity is attainable
due to exiting requirements, Fire Code regulations, other governing
requirements, or in the event that there are damages at the facility
that are not readily addressable.
3. No use shall occur before 3:00 p.m. or after 11:00 p.m., except by
written approval of the Director or the Director's duly authorized
representative.
4. Consumption of alcoholic beverages shall be limited to beverages
purchased from the respective licensed restaurant concessionaire.
No outside alcohol may be brought onto, or consumed at, the golf
course.
5. All permittees shall be responsible for returning the multipurpose
room to its pre-use condition, including setting up, cleaning,
dismantling, and storing of all tables, chairs and other
appurtenances.
a. Clean-up of the multipurpose room shall begin no later than
10:30 p.m. on each use date.
b. The multipurpose room shall be returned to its pre-use
condition, vacated, and secured no later than 11:00 p.m.
c. Failure to return the multipurpose room to its pre-use
condition, failure to vacate it by 11:00 p.m., failure to
properly secure or causing damage to the multipurpose
room or its contents shall result in forfeiture of the
permittee's full security deposit.
d. The permittee is responsible for any and all damage caused
to the multipurpose room on the day(s) the permittee is
authorized to use the facility.
6. Organizers of approved golf tournaments and tournament players
shall have exclusive use of the multipurpose room on the day(s) the
tournament is/are held. While tournaments are occurring, use of the
multipurpose room shall be off-limits to persons not participating in
or associated with the approved tournament.
Section 4 Fees for the Hilo Municipal Golf Course and Multipurpose
Room
The following schedule sets forth the fees and charges applicable to the Hilo
Municipal Golf Course.

The Monthly Card, which shall be available only to Hawai'i Island residents, entitles
the golfer to one (1) complete round of golf consisting of eighteen (18) holes of play
per day and may not be used for tournament play. Subsequent rounds may be
allowed, but will be based on availability of starting times.
*Additional charge of five dollars ($5) per round will apply for all Weekend/Holiday play
and two dollars ($2) per round will apply for all Weekday play using a Monthly Card. The fee shall
be paid in advance and does not waive the requirement of registering to play and reserving a
starting time.
The following schedule sets forth the fees and charges applicable to leasing
the Hilo Municipal Golf Course Multipurpose Room.
B. Multipurpose Room Fee Schedule
Rental Fee: $200.00/day*
Refundable Security Deposit: $400.00/use**
*Use shall be limited to between the hours of 3:00 p.m. and 11:00 p.m.
**Permittee shall return all keys no later than 12:00 p.m. on the day immediately following the
latest use date. Failure to return all keys in undamaged condition by the deadline shall result in
forfeiting two hundred dollars ($200) of the refundable security deposit.
Section 5 General Rules Affecting the Public
A. Activities not relating to golfing, including but not limited to jogging,
walking, skateboarding and bike riding, are not allowed on the golf course.
B. The Hilo Municipal Golf Course pro shop concessionaire shall have the
exclusive right to golf lessons conducted on a fee basis at the Hilo
Municipal Golf Course.
C. No private riding golf carts shall be allowed on the golf course, unless

used to provide access for a golfer with mobility impairments.
D. Players shall abide by these rules and regulations and all posted
regulations at the facility.
E. Any person who knowingly, willfully and maliciously damages the course
or golf course property shall be duly prosecuted.
F. No animals shall be allowed on the golf course, except for service
animals.
G. No bicycle, moped, go-cart, skate, motorcycle, skateboard, tricycle or
similar items shall be permitted on the golf course.
H. Only authorized vehicles shall be permitted on the golf course.
Minors under the age of nine (9) years shall not be allowed on the course
unless they are registered to play and are accompanied by an adult.
J. All permittees of the Hilo Municipal Golf Course are responsible for
ensuring their use complies with the current Americans with Disabilities
Act. Any provisions or accommodations necessary to ensure compliance
with such shall be the sole responsibility of the permittees and shall not
cause irreparable harm or pose a danger to other golf course patrons or
staff.
Section 6 Rules of Play
A. The order of play shall be determined by assigned starting times as
designated through starting time registration procedures.
B. Players shall be ready to tee-off fifteen (15) minutes prior to their assigned
tee times.
C. Reserved starting times will not be honored after the assigned starting
time has elapsed. Tardy players will be required to re-register for new
starting times.
D. Registered clubs that have received starting times confirmed by the
Administrator shall be assessed a penalty of four dollars ($4) for each
uncancelled and unused starting time. Such penalty to be due and
payable before the club's next confirmed starting time. A cancellation shall
be made at least three (3) days prior to any confirmed starting time.
E. Play shall start at the Number One (1) tee unless otherwise directed by
the Starter.

F. Holes shall be played in numerical sequence.
G. The Marshal may authorize faster players to pass slower players/groups.
H. All players shall abide by the United States Golf Association (USDA) rules
of etiquette at all times.
Maximum number of players per group shall be six (6).
J. Within the allowable maximum, the Starter may adjust the number of
players per group by reducing the group size, or combining groups when
course conditions warrant such adjustments.
Section 7 Rules Affecting Players
A. No person shall be allowed on the course to play golf without first
registering at the golf course Starter's Office.
B. Each player shall have his/her own clubs.
C. A player shall replace divots on the fairways and ball marks on the greens.
D. The putter shall be the only club used for putting on the greens.
E. Driving a ball from the green is prohibited.
F. Golf bags shall not be laid on the greens and pull carts shall not be
operated within five (5) feet of any green..
G. Riding carts shall not be driven or parked within twenty (20) feet of the
edges of the greens and shall be kept off the tees unless being used by a
person with mobility impairments. The Administrator may extend the area
around the greens and the tees and delineate other areas where riding
carts are prohibited when weather and other conditions warrant such
restrictions.
H. During adverse weather conditions, all riding carts shall be driven and
parked on the paved pathways only.
1. Any individual who operates any electric or gasoline-riding cart on the
course must possess a valid driver's license.
J. Riding carts shall not be driven or parked within any structure not intended
for such use, including, but not limited to, rain shelters, comfort stations,
covered walkways, etc. Riding carts shall not be driven in the golf course

parking lots or driveways where vehicular traffic occurs. No exceptions
allowed.
Section 8 Parking at the Hilo Municipal Golf Course
A. Parking shall be reserved for patrons actively using the golf course or
concessionaries.
B. Public parking shall be allowed only in marked parking stalls. Stalls
located adjacent to the cart-storage building shall be reserved for use by
the Starters' Office, pro shop concessionaire and restaurant
concessionaire. Loading zones and other areas where parking is
regulated or prohibited shall be clearly identified.
C. All golf course parking areas shall be locked and off-limits nightly at or
around 11:00 p.m. nightly. Gates will be reopened at or around 5:30 a.m.
D. The County of Hawaii will not be responsible for any vehicle left
unattended in a golf course parking lot after the parking area's gates have
been closed/locked.
Section 9 Miscellaneous Rules
A. The sale of golf supplies, equipment, attire, as well as food, beverages,
and refreshments is prohibited except through the respective licensed
concessionaires.
B. Alcoholic beverages are not allowed on the golf course with the exception
of within the food and drink concession area or as otherwise approved by
the Director and in conformance with the all liquor regulations.
C. Disposal of any type of litter except in containers provided for that purpose
is prohibited.
D. The County of Hawaii will not be responsible for the loss of items left at
the golf course, including vehicles and their contents left parked in the
course parking lot.
E. The Director may extend courtesy privileges to visiting dignitaries, certified
golf professionals, and others. For the purpose of this section, courtesy
privileges shall consist of waiving of green fees.
F. Proper attire is expected on the golf course at all times. Golf/athletic
shoes, shirts, (covering the entire chest and abdomen) and
shorts/skirts/pants must be worn at all times. Swimming attire such as
bikinis, briefs, slippers, etc. are prohibited.

Section 10 Tournaments
A. Reservation requests for tournaments shall be made in writing to the
Administrator.
B. A minimum number of one hundred twenty (120) golfers is needed to hold
a tournament whose participants have exclusive use of the Hilo Municipal
Golf Course.
C. Except as provided in Subsection D, below, the following schedule sets
forth the fees and charges applicable to all tournaments held at the Hilo
Municipal Golf Course:
1. A tournament reservation deposit of four hundred dollars ($400)
shall be required within ten (10) days from the date that the
tournament request has been approved by the Administrator.
Failure to make such payment in a timely manner shall result in the
cancellation of the tournament reservation. The reservation deposit
fee shall be non-refundable unless the tournament reservation is
cancelled by the Administrator;for reasons beyond the control of
the tournament organizer or the golf course is deemed to be
unplayable by golf course personnel on the day of the tournament.
2. After the tournament date(s) has/have been confirmed, the
tournament reservation fee shall be converted to a refundable
security deposit to meet the conditions of Section 4 (B).
3. Shotgun Tournaments: A fee of six hundred dollars ($600) or five
dollars ($5) per entrant, whichever is greater, will be assessed for
all shotgun tournaments held at the golf course.
4. Regular Tournaments: A tournament fee of five dollars ($5) per
entrant, per day, will be assessed for all regular tournaments.
5. Special Activities: A fee of ten dollars ($10) per participant will be
assessed for all non-tournament fundraising activities conducted on
the golf course. All such activities shall be required to receive prior
written approval of the Administrator.
6. All tournament fees, less deposits, shall be due and payable two (2)
days prior to the starting date of the tournament.
D. Upon the receipt of a written request therefore, the Director shall be
authorized to waive any and all of the hereinabove fees for tournaments
and/or activities sponsored by nonprofit groups and associations whose
sole objective is to promote the sport of golf or to assist and develop

public links, junior golf and/or high school golf programs for Hawaii Island
residents.
Section 11 Penalties
A. Any person who deliberately violates any rule or regulation may be
prosecuted as provided by law for the prosecution of misdemeanors.
B. Other penalties, additionally or separately, may be imposed in accordance
with Section 3 A (7).
Section 12 Appeals Procedure
A. Citation
Any person who feels that he or she has been unjustly cited for violation
may appeal the citation to the Director within thirty (30) days of such
citation, pursuant to Rule 1 of the Rules and Regulations of the
Department of Parks and Recreation.
B. Misdemeanor and Parking Violations
When the penalty imposed is the result of the prosecution and conviction
of a misdemeanor or a violation of parking provisions, the appeal shall
be in accordance with State statutes and/or County ordinances.
Section 13 Severability Clause
If any provision of these rules, or the application thereof to any person or
circumstance is held invalid, such invalidity shall not affect other
provisions or applications of the rules which can be given effect without
the invalid provision or application, and to this end, the provisions of these
rules are declared to be severable.

of Hawaii, State of Hawaii, do hereby certify:
1. That the foregoing is a full, true and correct copy of the amendments to the Rules
and Regulations of the Department of Parks and Recreation on matters relating
to the Hilo Municipal Golf Course which were adopted on January 21, 2020, after
a public hearing was held in Hilo on January 15, 2020.
2. That notice of the public hearing on the foregoing rule, which included a
statement of the substance of the proposed rule, was published in both the
Hawaii Tribune-Herald and the West Hawaii Today on December 15, 2019.
