UNFINISHED BUSINESS Permitted Interaction Group (PIG) Report: Discussion regarding the Permitted Interaction Group formed on August 30, 2024, to review and recommend amendments to the Police Commission's Rules of Practice and Procedure. At its meeting on December 19, 2025, the Commission agreed to have the PIG's report formally presented at the February meeting. Hawai `i County is an Equal Opportunity Provider and Employer. Distribution of Commission Meeting Packets: Discussion and consideration of electronic distribution of meeting packets, including potential use of email or a shared folder, as well as logistical, confidentiality, and IT requirements. EXECUTIVE SESSION (CLOSED TO THE PUBLIC) For the following agenda items, the Commission will meet in executive session to consider charges against officers or employees of the police department, where matters affecting privacy will be involved and may consult with the board's attorney on questions and issues pertaining to the Commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS § 92-5 (a)(2)(4) and the Hawaii County Charter Section 13-20 (b). VI. REVIEW OF BACKGROUND CHECK AND INVESTIGATION OF REED MAHUNA VII. AND CONSIDERATION OF REED MAHUNA FOR PERMANENT APPOINTMENT AS POLICE CHIEF (EXECUTIVE SESSION — CLOSED TO THE PUBLIC) Correspondence No. 26-03: The Commission will review the results of the background check and investigation of Reed Mahuna conducted by Assistant Chief Sherry Bird, which included a criminal background check, pre -entry medical examination, drug screening, and background investigation. The Commission will determine whether to appoint Reed Mahuna as Police Chief in open session, under agenda item IX. CONSIDERATION AND INVESTIGATION OF COMPLAINTS (EXECUTIVE SESSION — CLOSED TO THE PUBLIC) • HPC 25-41: Complainant alleges that the officer did not take a report, provided inaccurate information, and was disrespectful. • HPC 26-02: Complainant alleges that the officer's report was inaccurate and false, and that no response was received despite multiple attempts to contact the officer. • HPC 26-05: Complainant alleges that officers did not listen to his version of events after his vehicle was struck, prepared an inaccurate police report, and arrested him, during which he was treated improperly while in custody. • Correspondence No. 26-02: Correspondence alleging unprofessional and hostile conduct by an officer. • Complaints in the non -acceptance category. The Commission shall begin the review process [provide the month or state the time relative to the budget cycle and or the chiefs draft submission]. It was an impressive list and I do hope that those who do decide to make Hawai'i Island their home will get involved — we need and welcome their expertise and dedication to public safety. It goes without saying that I support the appointment of Reed Mahuna as Chief. I do think this entire situation, recruitment process and the conversations generated across the island have been beneficial to helping us all think deeply about public safety, law enforcement and what role each of us plays in this — more so in these very challenging times. It's really easy to settle into a mindset of let "them" take care of it, but even yesterday during the Interim Chief's first community talk story in Waimea, it was abundantly clear that there is no "they" — but rather, "we" — all of us working together that will make all of us safer. What I really want to briefly say today is a hope that this commission and the department commits going forward to an even closer partnership with the community. Our Community Policing program is very important. The monthly newsletters and reports such as on DUls and Fentanyl and other drug enforcement actions are important. CPO officers and others attending community meetings is important — and I mean this for police commissioners as well as department personnel. This level of community outreach is daunting for everyone - volunteer commissioners, HPD officers and staff, all of whom already have full plates. But serious community engagement is essential even though the conversations are at times going to be difficult and frustrating. But developing and nurturing healthy, respectful partnerships is essential. One small example of the work ahead, I think, is expanding on the new "courtesy livestreaming" of commission meetings. I'm grateful for this addition to meetings, but strongly urge that in the next round of county budgeting, funding be sought to transition to the same format used for County Council and Planning Commission meetings — such that community members can participate — not just listen in - from County satellite offices or personal devices and also be able to listen to archived recordings of meetings. This step toward greater transparency puts added pressure on everyone, but it's how democracy works best when there's accountability. also hope that the department under the new Chief will continue the new Community Talk Stories in communities around the island and try different times of day and settings to hear from as many as possible. The first such talk story this past Wednesday was small but produced good conversations and also helped build a better understanding of the complexity of circumstances and issues we are dealing with. I thought most everyone who attended left thinking it had been time well spent but also that they personally had work to do. Each of us has a responsibility to do what we can. also hope the department will work with the community in addressing its budgetary challenges and emerging policy issues as well as help with recruitment and advocacy for public safety. Lastly, I continue to urge HPD leadership, officers and staff and this commission to continue to embrace the Spirit of Aloha. In closing, I thank all of our HPD officers and staff for being willing to provide an essential service 24/7/365 to keep us all safer. On our first day of training, we were assigned lockers in the police station locker room. The I instructor told us "Yes, this is a police station... and yes, you should still lock your lockers' Up until that very moment, my view of police officers was one of highest integrity, moral character, ethics, and professionalism. As a young civilian, I had never even imagined officers entrusted with upholding the law engaging in nefarious., unethical, or unlawful activities. Having have had a combined total of —10 years as a Police Officer and Reserve Police Officer, I can tell you with 100% confidence that police officers are human and subject to human emotions, as well as temptations and errors in judgement just Like everyone else. An extreme example is the infamous case involving a certain former Police Chief from a neighboring island. Thankfully, most officers and rank I worked with over the years were genuine, good people trying to do the right thing; like the individual I endorsed and recommended for the Police Chief position. Unfortunately, there are a few that would happily take advantage of any opportunity to do things in their own best interest versus doing what is best for the community and department personnel. I understand there is Likely no way to prove any impropriety occurred from any of the candidates, and to be fair, all candidates may have "played by the rules"; but for anyone paying attention, the opportunity to Leverage for advantage was very apparent; especially for those who were interviewed Late in the day and brought notepads to reference. I missed one or two interviews, but I observed only one candidate with the integrity,, courage, and confidence to go through the questioning without any reference materials. In my humble opinion, candidates (at any level), should not be allowed to bring notes in any form for an interview. A Police Chief should have the ability to formulate articulate thoughts and cogent responses "on the fly" and present them clearly and confidently. While I appreciate the live feed, if the candidates are not going to be sequestered, then the interviews should be recorded and streamed for the public only after all candidates have completed their interviews. My second concern is allowing personnel who have openly expressed support for the chosen candidate to be responsible for the background checks of said candidate. I know the checks are mostly for the sake of formality, but again, it Leaves a potential opportunity for the investigation to be compromised, or at the very least the optics that a compromise could occur. To keep everything "above -board", an independent, outside investigator able to adhere to what you commissioners have determined will be the "Hawaii County Police Department Standards" of background checks should be utilized. Mythird concern is the health and fitness of the Police Chief and aLL other sworn officers of the law at every Level. I realize that Chief Officers will, very Likely never need to physically pursue or subdue a suspect while on duty. However, as a sworn officer of the Law (and Likely still collecting a monthly 4,; standard of conduct" stipend), a Chief officer still has the responsibility and duty to act if a crime is committed in his/her presence whether on or off duty. Sworn Officers at every level need to be physically capable of responding appropriately. A Chief Officer should Lead by example and be held to the same health and fitness standards as his/her subordinates. I understand it is not easy to maintain peak physical fitness as we age, but a Chief Officer who puts in time and effort to maintain their health and fitness implies self-discipline, self- control, and the willingness to put in hard work towards a favorable outcome. Those qualities should be requisite of someone in a leadership role, especially in a paramilitary organization. A physically fit Chief will also have a greater Command Presence and will typically garner more respect from both the public and tine personnel (even if only subconsciously) than those who are not. He/she would serve as an example and could expect his/her subordinates to maintain a reasonable standard of physical fitness. The body Language of candidates during proceedings should also be considered. Anyone vying for any position or promotion (from new recruits to the Police Chief) should carry (and seat) themselves in a confident but respectful, and professional manner. Watching candidates during the proceeding that, were seated like they are sitting on a couch at home watching TV does not inspire much confidence as it implies boredom, Laziness, and contempt for the process. My final suggestion would be to have more transparency for the random selection for the order of the interviews. If it is too cumbersome or difficult to show the actual drawing of names to the public (in -person or via Live feed), I believe, at the very Least, the candidates should be able to witness the entry of names on folded pieces of paper into a clear container where the names are then drawn at random., up close, and in plain view of all candidates. This will give the candidates confidence that no manipulation of the order can occur. Also, are the candidates allowed/encouraged to view their interview scores? And will those scores be made publicly available? This Letter is not meant to demean anyone or any part of the process. I simply noticed a few things that I felt were concerning ancl wantecl to bring them to your attention. I also wanted to present possible solutions and/or alternatives that may help to maximize the transparency and integrity of such an important process.
