B.“Director" shall mean the Director of the Department of Parks and Recreation; County of Hawai‘i. C.“Department" shall mean the Departmentof Parks and Recreation of the County of Hawai‘i. D."Sports Official”shall mean a person recognized by the Director as an officiator of a County-sponsored sports game.Such sports officials may be an independent contractor or a volunteer skilled in the knowledge and application of the rules of play for the sport in which he officiates. E."Sport" shall be defined as any organized athletic activity including but not limited to badminton, baseball, basketball, boxing, football, soccer, softball, swimming, diving, track and field and volleyball. F."Person with Disabilities" shall mean, with respect to an individual, a physical or mental impairment which substantially limits one or more major life activities of such individual, a record of suchan impairment nor being regarded as having such an impairment. G.Service Animal” shall be defined by the current Americans with Disabilities Act, Title II and Title III rules. Section 2General Provisions -County-Sponsored Sports Leagues A.Participant Eligibility 1.The Director shall be empowered to establish and enforce such participant eligibility criteria as may be necessary for the safe and efficient management of each County-sponsored sports league. 3 The purposes of such criteria are to: a.protect participants from physical injury; b.protect participants from emotional trauma; c.provide for reasonable levels of participant compatibility; d.maintain reasonable controls over the expenditure of public funds; e.maintain the objectives of the Department directed towards increasing individual public participation in recreational activity; and f.eliminate where practicable the duplication of recreational services provided by the Department with that of other public or private agencies and organizations. 2. Eligibility criteria shall be available to the public for inspection at the office of the Department of Parks and Recreation. 3. Persons or teams found to be in violation ofestablished eligibility criteria may be: a.subject to suspension from furtherparticipation in league play; b.cause for the forfeiture of all games played by the ineligible person; and c.subject to other appropriate administrative sanctions as may be necessary to fulfill the objectives of Section 2 A (1)of these rules. B.Sports League Rules 1.The Director shall adopt such nationally recognized rules of each sport as are necessary to achieve the objectives of the Department. 2.The Director may make such additions or modifications to such nationally recognized rules as are necessary to achieve the objectives of the Department. 4 3.The Director shall, upon request, make available for inspection, all rules governing the operations of the Department's County-sponsored sports leagues at the office of the Department of Parks and Recreation. C.Conduct of coaches, sports officials, volunteers, participants or spectators at County-sponsored sports league games 1.The Director may take such actions as are necessary to remove, restrain or otherwise prohibit any coach, sports official, volunteer, participant or spectator from any act or action which may be detrimental to the safe, healthful and orderly conduct of the Department's sports league or which poses a threat to health, safety or welfare of persons, or threat of property damage. Such action taken by the Director may include prohibiting attendance, coaching, officiating or participating in any or all County-sponsored sports leagues for such a period of time as the Director deems necessary to the safe and efficient conduct of its sports league games. 2.Appeals relative to the enforcement of this rule may be made in accordance with Section 2 D (1)of these rules. D.Petition for declaratory rulings, decisions of the Director, and or the adoption, amendment or repeal of these rules 1.Any interested person may petition the Director requesting a declaratory ruling or the adoption, amendment, or repeal of these rules stating the reasons therefore. 2.Such petitions shall be typewritten and submitted to the Directorof Parks and Recreation,101 Pauahi Street, Suite 6, Hilo, Hawai‘i 96720. 3.The Director shall render a decision relative to all appeals within thirty (30) days from the date of submittal.Such decision shall be in writing. Section 3Severability Clause If any provision of these rules, or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the rules which can be given effect without the invalid provision or application, and to this end, the provisions of these rules are declared to be severable. 5 CERTIFICATION I, Clayton S. Honma, Director of the Department of Parks and Recreation of the County of Hawaii, State of Hawaii, do hereby certify: 1. That the foregoing is a full, true and correct copy of the amendments to the Rules and Regulations of the Department of Parks and Recreation on matters relating to County -Sponsored Recreation Sports Programs which were adopted on December 31, 2013, after public hearings were held in Hilo and Kona on December 13, 2013. 2. That notice of the public hearings on the foregoing rule, which included a statement of the substance of the proposed rule, was published in both the Hawaii Tribune - Herald and the West Hawaii Today on November 10, 2013.
