RULE 13 -RULES RELATING TO COUNTY SKATEBOARDING FACILITIES
Section 1Rules and Regulations
A.No skateboards with metal shields or any other device which may be
dangerous or hazardous to the safety of others shall be allowed in the
skating facility at any time. No outside ramps, equipment, or jumps are
allowed in the facility unless prior approval is obtained from the
Department.
B.Profanity, recklessness, boisterous behavior, tandem riding, pushing, etc.,
are prohibited in the skating facility.
C.There shall be no intentional kicking out or off of the skateboard for the
purpose of hitting another person or object with the skateboard, or
intentional lossof control of the skateboard. Any airborne maneuvers
involving parting from the skateboard must be with the intention of
returning to the board at the completion of the maneuver.
D.Only skateboards and skates are permitted. No other equipment,
apparatus or vehicles, including bicycles, mopeds or scooters are allowed
in the facility.
E.Alcohol, Tobacco and Drugs are prohibited. Excessively loud music and
noise are also prohibited.
F.Food and drinks are not allowed within the skating facility.
G.It is strongly recommended thatall participants wear proper protective
gear including: covered shoes, knee pads, elbow pads, and safety
helmets.
H.Hours of operation shall begin no earlier than 7:00 a.m. and end no later
than 7:00 p.m., and must be approved by the Directoror the Director’s
duly designated representative.
I. All operators and lessees of skateboard facilities are responsible for
ensuring their use complies with the current Americans with Disabilities
Act.

Section 2PenaltyProvisions
A.Violation of these rules may subject the offender to administrative penalty
under Subsection B and criminal petty misdemeanor penalty of
Subsection C.
B.Any person who violates any rule or regulation may be suspended or
permanently banned by the Director from using the skateboarding
facilities.
C.Any person who violates any rule or regulation promulgated under the
authority of Section 2-60, Hawai‘i County Code, shall, upon conviction, be
fined not more than the sum of two hundred fifty dollars ($250).
Prosecutions in such cases shall be provided by law for the prosecution of
petty misdemeanors.
Section 3 Severability Clause
A.If any provision of these rules or the application thereof to any person or
circumstance is held invalid by a court of competent jurisdiction, such
invalidity shall not affect other provisions or applications of these rules which
can be given effect without the invalid provision or application, and to this end
the provisions of these rules are declared to be severable.

of Hawaii, State of Hawaii, do hereby certify:
1. That the foregoing is a full, true and correct copy of the amendments to the Rules
and Regulations of the Department of Parks and Recreation on matters relating
to County Skateboarding Facilities and Skateboarding Safety Rules which were
adopted on December 31, 2013, after public hearings were held in Hilo and Kona
on December 13, 2013.
2. That notice of the public hearings on the foregoing rule, which included a
statement of the substance of the proposed rule, was published in both the
Hawaii Tribune -Herald and the West Hawaii Today on November 10, 2013.
