;M�V COs. <br /> n <br /> • <br /> • r <br /> COUNTY OF HAWAIISTATE OF HAWAII <br /> •"isOF Mti <br /> RESOLUTION NO. 715 20 <br /> RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR UTILITY <br /> PURPOSES AT KOHOLALELE, DISTRICT OF HAMAKUA, COUNTY AND STATE OF <br /> HAWAII, TAX MAP KEY: (3)4-2-005:001(por.) AND (3)4-2-005:005(por.) TO HAWAII <br /> ELECTRIC LIGHT COMPANY, INC. <br /> WHEREAS, the County of Hawaii ("County") owns Tax Map Key: (3)4-2-005:001 and <br /> (3)4-2-005:005; and <br /> WHEREAS, HAWAII ELECTRIC LIGHT COMPANY, INC. ("HELCO") has a <br /> Revocable Right of Entry Agreement with the County of Hawaii dated August 2, 2011, over and <br /> across these areas designated as Easements E-1-A and Easement E-1-B; and <br /> WHEREAS, HELCO now seeks to increase its interest from a Revocable Rights of Entry <br /> to a Grant of Easement and has offered to pay TWENTY-SIX THOUSAND THREE HUNDRED <br /> AND NO/100 DOLLARS ($26,300.00) for rights of easement for Easements E-1-A and Easement <br /> E-1-B; and <br /> WHEREAS, an appraisal report commissioned by the County of Hawaii, Department of <br /> Finance determined the easement market value to be TWENTY-SIX THOUSAND THREE <br /> HUNDRED AND NO/100 DOLLARS ($26,300.00); and <br /> WHEREAS, due to the configuration of the easement area it would be impractical for any <br /> other entity to utilize this limited area and therefore direct negotiation with HELCO for these <br /> easements are authorized; and <br /> WHEREAS, pursuant to sections 2-111(2) and 2-112, Hawaii County Code, the Council <br /> is authorized to grant easements, subject to revert to the County of Hawaii upon termination or <br /> abandonment of the specific purpose; now, therefore, <br />
