Chung, Council Chair <br />and Members of the County Council <br />County of Hawaii <br />25 Aupuni Street <br />Hilo, HI 96720 <br />Dear Chair Chung and Council Members: <br />Nancy Carr Smith, Chair <br />Perry Kealoha, Vice -Chair <br />Scott Church <br />Mark Van Perris <br />Michael Vitousek <br />Faith "Faye" Yates <br />SUBJECT: Amendment to Change of Zone Ordinance No. 05-113 (REZ 04-000024) <br />Request: Amendments to Conditions B, C, D, E, F, H, I, U, V, X, and Z <br />Applicant: Suffolk Investment LLC <br />Tax Map Key: 7-5-017:019 <br />The Leeward Planning Commission, at its continued meeting on August 20, 2020, reviewed and <br />acted on the above -referenced requests an amendment Condition B (Time to Pay Water Deposit), <br />Condition C (Time to Complete Construction), Condition D (Delete Rental Housing Restriction), <br />Condition E (Delete Requirement for Supplemental TIAR), Condition F (Roadway Improvements), <br />Condition H (Location of Spine Road within Project Site), Condition I (Kuakini Highway <br />Improvements), Condition U (Requirement of a 5 -Acre School Site & Improvements), Condition V <br />(Fair Share), Condition X (Affordable Housing Requirement and Change Housing Program <br />Approving Authority) and Condition Z (Administrative Time Extension) of Ordinance No. 05-113. <br />The property is situated west (makai) of Queen Ka`ahumanu Highway and east (mauka) of <br />Kuakini Highway, and the Kahakai Estates Subdivision, approximately 2,200 feet north of the <br />Queen Ka` ahumanu Highway — Kuakini Highway intersection, Puapuaaiki 1St, North Kona, <br />Hawaii. <br />The Commission voted to send an unfavorable recommendation to the County Council, <br />ultimately adopting the Planning Director's reasons for the unfavorable recommendation as <br />follows: <br />The applicant, Suffolk Investment, LLC has submitted an application to amend <br />numerous conditions of Change of Zone Ordinance No. 05-113, which was originally <br />approved on August 5, 2005 to change the zoning of the subject property from <br />Hawai `i County is an Equal Opportunity Provider and Employer <br />
