(2) Wastewater Division The wastewater division shall be responsible for the <br />construction, maintenance, and operation of all sewage programs and facilities <br />operated by and for the County." <br />SECTION 6. Chapter 2, article 40, section 2-204, of the Hawaii County Code 1983 (2016 <br />Edition, as amended) is amended by amending subsection (a) to read as follows: <br />"(a) If the director determines that any person has violated or is violating any provision of this <br />article [eY e apters 20 o ] ch' ch, apter 21 s or any rule adopted pursuant to these chapters, the <br />director may do any one or more of the following: <br />(1) Issue an order assessing an administrative penalty for any past or current violation; <br />(2) Require compliance immediately or within a specified time; and <br />(3) Commence a civil action in the circuit court for appropriate relief, including a <br />temporary, preliminary, or permanent injunction, the imposition and collection of <br />civil penalties, or other relief." <br />SECTION 7. Chapter 2, article 40, section 2-205, of the Hawaii County Code 1983 (2016 <br />Edition, as amended) is amended to read as follows: <br />"Section 2-205. -Penalties. <br />Any person who violates this chapter [^r ehapter-s 20 or-], chapter 21, any rule adopted <br />pursuant to these chapters, or any condition of a permit or variance issued pursuant to this <br />chapter shall be fined not more than $1,000 for each separate offense. Each day of each violation <br />shall constitute a separate offense. Any action taken in court to impose or collect the penalty <br />provided for in this subsection shall be considered a civil action." <br />SECTION 8. Chapter 2, article 40, section 2-207 of the Hawaii County Code 1983 (2016 <br />Edition, as amended) is amended by amending the section number assigned to this section to <br />read as follows: <br />"Section [2-07.] 2-204. Environmental management commission." <br />PART IIl. REPEALED PROVISION <br />SECTION 9. Chapter 14, article 20, sections 14-115, 14-116, 14-117, 14-118, 14-119 of <br />the awai`i County Code 1983 (2016 Edition, as amended) are repealed. <br />1 P .. <br />14 <br />
