DPW also recommends intersection improvements at the Road <br /> 1-Mamalahoa Highway intersection; however, Mamalahoa Highway is under <br /> State DOT jurisdiction so the applicant will need to provide intersection <br /> improvements as required by DOT. Lastly, DPW recommends an approved <br /> archaeological inventory survey be completed for the alignment prior to bonding, <br /> because a right-of-way that has not been verified for archaeological resources <br /> may require re-alignment. <br /> Delete Condition V6: This condition requires safety improvements on <br /> Mdkdlei Drive to provide a safe transition at the point where University Drive <br /> connects to Mdkdlei Drive. The condition also requires that Mdkalei Drive not be <br /> opened for public traffic until Road 1 is completed and opened for public use. <br /> Mdkdlei Drive between the Palamanui property and highway 190 (Mamalahoa <br /> Highway) was deeded from Hiluhilu Development LLC to the Mdkdlei Estates <br /> Community Association in July 2015 and therefor is a private roadway. The <br /> original zoning ordinance (Ord. No. 83 850) for Mdkdlei Estates and the <br /> Palamanui lands required Mdkdlei Drive be built within an 80-foot wide right-of- <br /> way and extended to Queen Ka`ahumanu Hwy when the makai lands (Palamanui <br /> lands) were developed. In 2006, when a Project District was created for the <br /> Palamanui development, the County Council deleted this condition (Ord. No. 06 <br /> 106) because Makdlei Drive had already been constructed as a 50-foot wide right- <br /> of-way and Palamanui's Ordinance No. 06 105 and the Land Use Commission's <br /> Decision and Order required them to construct Road 1 as a mauka-makai collector <br /> roadway between Queen Ka`ahumanu Highway and Highway 190. <br /> The Planning Director supports deletion of this condition since Palamanui <br /> does not own Mdkdlei Drive and therefore would not be able to fulfill the <br /> condition and Palamanui will provide Road 1 as an alternate connection between <br /> Queen Ka`ahumanu Highway and Mamalahoa Highway. <br /> Add Condition V7 (new Condition S6h This condition relates to Road 6A. <br /> The applicant requests adding this condition to specify that Road 6A shall be a <br /> public roadway within a 60-foot wide right-of-way and constructed in conjunction <br /> with any of the project's development requiring access from said road. <br /> The Planning Director agrees with the applicant's amendments with <br /> modifications, to state the road shall be constructed meeting DPW requirements <br /> and be dedicated to the County upon request and no cost to the County. <br />
