Chung, Council Chair <br /> and Members of the County Council <br /> County of Hawaii <br /> Page 19 <br /> In addition to the applicant's above requested amendments, deletion <br /> and addition to conditions,the Planning Director recommends deletions, <br /> additions, and amendments of other existing conditions in the ordinance, to <br /> include but not be limited to the following conditions, to reflect the current <br /> standard language for conditions of approval and to reflect conditions the <br /> applicant has already complied with. <br /> New Condition C is added to include a standard definition for `occupancy' <br /> throughout the ordinance. Several conditions of the ordinance reference <br /> occupancy as the trigger or deadline for providing road and park improvements. <br /> The Planning Director recommends adding this condition, which uses the <br /> definition of`occupancy' from the Concurrency Standards section of the Zoning <br /> Code. In this definition there are three types of occupancy triggers for various <br /> land uses. The first is at final subdivision approval by the Planning Department <br /> when single-family residential lots are created but homes are not yet built before <br /> the lots are sold. The second is at issuance of a Certificate of Occupancy by DPW <br /> for commercial, industrial, hotel and multi-family residential units. The third is at <br /> issuance of a building permit for residential buildings that do not require a <br /> Certificate of Occupancy(typically single-family dwellings). <br /> Condition D (former Condition C)is amended to indicate a revised Water <br /> Master Plan is required for the new phasing plan and updates the condition with <br /> the most current Water Agreement on file, which is in the process of being <br /> amended. These amendments were recommended by the Department of Water <br /> Supply in their memo dated September 21, 2020. <br /> Condition I (former Condition J)is amended to reflect a Master Plan <br /> ("Regulating Plan") has been completed that is consistent with the Kona CDP <br /> according to the Kona CDP Design Center. After adoption of the amended <br /> ordinance, the applicant's Regulating Plan should be updated to reflect the <br /> amended ordinance conditions and provided to the Planning Department for <br /> implementation of the Project District. Policy LU-2.4 of the KCDP and Section <br /> 25-6-49.1 of Chapter 25 (Zoning Code) Hawaii County Code, allow amendments <br /> to the Master Plan to be processed by the Planning Director, if authorized in the <br /> Project District ordinance by the County Council. Given the project size, <br /> complexity of implementing new planning concepts of design and smart growth, <br /> and anticipated lengthy duration of the project, it is reasonable to anticipate that <br /> some changes may be needed to the current Master Plan ("Regulating Plan"). <br /> Thus, the Planning Director recommends amendment of this condition to give <br />
