The non-performance is the result of conditions that could not <br /> have been foreseen or are beyond the control of the applicants, <br /> successors or assigns and that are not the result of their fault <br /> or negligence. <br /> Mrs. Lilian Mahi had originally sought the change of zoning and a <br /> subdivision of the property unfortunately she was unable to finish <br /> before passing away. The current owners, Ernest and Elizabeth <br /> Young, would like to finish what Lilian Mahi started. <br /> 2. Granting of the time extension would not be contrary to <br /> the General Plan or Zoning Code. <br /> This request for an extension of time continues to be consistent with <br /> the General Plan's Land Use Pattern Allocation Guide (LUPAG) <br /> Map, which designates this area for Urban Expansion. Urban <br /> Expansion Area allows for a mix high density, medium density, low <br /> density, industrial and/or open designations in areas where new <br /> settlements may be desirable, but where the specific settlement <br /> pattern and mix of uses have not been determined. The area under <br /> consideration is consistent with the urban form established for this <br /> section of the North Kona District as depicted on the LUPAG Map. <br /> The Kona Regional Plan, adopted by Resolution No. 1 84, <br /> recommends the area for residential four (4) units per acre. The <br /> applicant's proposal is a single family residential subdivision. It is <br /> adjacent to a residential subdivision called Kona Highlights. The <br /> reclassification is for a similar urban land use designation. <br /> proposed <br /> Thus, the requested boundary amendment would be in the direction <br /> of fulfilling the low density range plans, in this particular case. <br /> Furthermore, an Urban classification would complement the existing <br /> and future residential land use patterns of the surrounding properties <br /> in view of the adjacent Kona Highlands Subdivision. <br />
