a Resolution of Intention pursuant to Section 32-20, Hawaii <br /> County Code, and (b) undertake and carry out any and all <br /> activities necessary to complete and establish the Community <br /> Facilities District at Kaloko and Kohanaiki, North Kona, Hawaii. <br /> In furtherance thereof, PETITIONER submits and requests <br /> that the Community Facilities District be instituted in <br /> accordance with and subject to the following. <br /> I. <br /> OWNERSHIP <br /> PETITIONER is the owner in fee simple of one hundred <br /> percent (100%) of the entire area of land proposed to be <br /> included within the Community Facilities District located at <br /> Kaloko and Kohanaiki, North Kona, Hawaii, identified as TMK (3) 7- <br /> 3-009: 019, 057, 058, 059, 060, 061, 062 and 070, and more <br /> particularly described in the description attached hereto as <br /> Exhibit "B" . There are no lessees of such land who, by the <br /> express terms of any existing leases, are obligated to pay any <br /> special taxes levied on such land under Chapter 32, Hawaii <br /> County Code. <br /> II . <br /> ESTABLISHMENT OF COMMUNITY FACILITIES DISTRICT <br /> IS IN THE PUBLIC INTEREST <br /> PETITIONER submits that the establishment of the Community <br /> Facilities District is in the public interest within the meaning <br /> 4 <br />
