Maile David, Council Chair <br /> and Members of the County Council <br /> County of Hawai`i <br /> January 09, 2022 <br /> Page 10 <br /> similar Project District Zoning for other resorts in the area require the same, the Director <br /> recommends adding a condition of approval to require that all new internal roadways <br /> may be developed to the Subdivision Code's Resort Standards. The preceding and all <br /> other internal resort infrastructure and community facilities will be developed and <br /> maintained privately. <br /> Police, fire,medical, and emergency services are available nearby. According to a <br /> comment memo from the Police Department, the increase in population resulting from <br /> the 1,000+time share units (within the overall Kumu Hou project)will lead to an <br /> increased burden on public safety services such as police and fire/rescue. A condition of <br /> approval will require the applicant or successor to pay a fair share contribution to <br /> mitigate potential regional impacts from the development. <br /> In addition, the Planning Department will review site plans for each phase of <br /> development that are consistent with the overall master plan to ensure the following: <br /> • Adequate light and air, as well as proper siting and arrangements of all structures and <br /> improvements are provided. <br /> • Existing and prospective traffic movements will not be hindered. <br /> • Proper landscaping is provided that will be commensurate with the development or <br /> use and its surroundings. <br /> • Unsightly areas are properly screened (visually) or eliminated. <br /> • Adequate off-street parking is provided to serve the development or use. <br /> • Access to the parking areas will not cerate potential accident hazards; and <br /> • Within reasonable limits, any natural and man-made features of community value are <br /> preserved. <br /> As stated above,potential impacts associated with this project development such <br /> as traffic, drainage, and other design concerns will be mitigated through conditions of <br /> approval. Therefore, the request would not unreasonably burden the public agencies to <br /> provide roads and streets, sewer, water, drainage, school improvements,police and fire <br /> protection, and other essential services. The proposed PD zone change would allow for <br /> uses that complement the surrounding resort uses in the area. <br /> The development will to the extent feasible, reasonably protect native <br /> Hawaiian rights if they are found to exist. In view of the Hawai`i State Supreme <br /> Court's "PASH" and "Ka Pa`akai 0 Ka`Aina" decisions, the issue relative to native <br /> Hawaiian rights, such as gathering and fishing rights, must be addressed in terms of the <br />
