REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> DATE: February 8, 2022 Re: Bill No. 113/Communication No. 596 <br /> PLACE: Council Chambers <br /> Hilo, Hawaii <br /> TIME: 2:24 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 113, reports as follows: <br /> Bill No. 113, submitted by Committee Member Rebecca Villegas via Communication 596 dated <br /> January 18, 2022, amends Section 25-8-26 (Pahoa Zone Map), Article 8, Chapter 25 (Zoning) of <br /> the Hawaii County Code 1983 (2016 Edition, as amended), by changing the district <br /> classification from Single—Family Residential— 10,000 Square Feet(RS-10)to Village <br /> Commercial—20,000 square feet(CV-20) at Waiakahiula, Puna, Hawaii, covered by Tax Map <br /> Key 1-5-003:037. The applicant is Aguinaldo 4, LLC and the property area is 1.545 acres. <br /> The Windward Planning Commission provided a favorable recommendation for this change of <br /> zone, which would allow the applicant to use the three existing structures on the property for <br /> commercial purposes, then remove the structures and construct 13,520 square foot mixed-use <br /> medical, retail and office complex, with associated infrastructure. The property is located at <br /> 15-3070 Pahoa-Kapoho Road, on the southeast corner intersecting with Pahoa-Kalapana Road <br /> across Pahoa High School at Kahiahiku Homesteads in Puna. <br /> Planning consultants Sidney Fuke and Daryn Arai appeared before Your Committee in the Hilo <br /> Council Chambers to represent the applicant, Gilbert Aguinaldo. Mr. Fuke explained the <br /> circumstances of the application. In addition to the favorable recommendation by Windward <br /> Planning Commission, he noted there was no objection from the neighbors of the community. <br /> Committee Member Sue Lee Loy asked if the applicant read the terms and conditions of <br /> approval and accepts and acknowledges as outlined in Bill 113. Mr. Fuke stated that after he and <br /> Mr. Arai's review, the applicant found them acceptable. She also questioned Condition F, <br /> pertaining to the three structures that were developed under a different permit that are now <br /> moving into commercial zoning. She asked if an after-the-fact permit for the structures would be <br /> required, or if there is the ability to rehabilitate them to meet the construction requirements <br /> required under the commercial zoning. Mr. Arai answered that they provided the planning <br /> department with records that demonstrated all three structures obtained building permits and <br /> were able to secure certificate of occupancy. Transitioning to commercial should be possible. <br /> Ultimately, it will come down to a specific type of usage being contemplated. There may have <br /> to be some improvements or renovations. The applicant would be required to obtain additional <br /> approvals or reviews that will be necessary, which Mr. Aguinaldo has agreed to. <br /> PC Report No.:45 <br />
