Mr. Zendo Kern, Director <br /> March 21, 2022 <br /> Page 2 <br /> ® Subsequent to the rezoning action, the two (2) parcels (21+ acres) were then <br /> consolidated and resubdivicled into three (3) lots. Final approval was granted <br /> on November 21, 201 1. <br /> o Two (2) of these lots, consisting of 7+ acres each, covered the 14.5+ <br /> acre area of the Special Permit. The lot with the bottling plant was <br /> assigned TMK: 1-6-141: 001. The undeveloped portion of the Special <br /> Permit was assigned TMK: 1-6-141: 024. <br /> o The remaining lot consisted of 6.5+ acres and was assigned TMK: 1-6- <br /> 141: 002. <br /> 0 Several time extensions of the Special Permit to complete construction of the <br /> project were approved, with the last one occurring on February 1, 2018. <br /> (Exhibit C) <br /> ® The former owner, Hawai'i Island Distilling, LLC, (HID) sought a new <br /> Special Permit for another brewery, soft drink and water facility on the 6.5+ <br /> acre (TMK: 1-6-141: 002). In a letter, dated February 13, 2017, the Planning <br /> Department returned the application noting that the request and then applicant <br /> were similar to all of the other properties affected by the original Special <br /> Permit. The Department also suggested several options, one of which <br /> included the rezoning of the property into the General Industrial (MG-20) <br /> zone. (Exhibit D) <br /> • HID then sought and secured approval (Ordinance No. 17 65) of having that <br /> property rezoned from A-5a to MG-20 on September 29, 2017. (Exhibit E) <br /> The subject property was recently conveyed to the applicant, Ke'Aloha Lani, <br /> LLC. <br /> NATURE OF REQUEST <br /> As will be discussed below, in spite of the intended use being similar, the <br /> roadway and water improvement requirements will vary between a Special Permit and a <br /> Zone Change/Subdivision. As I--IID then and, now the current applicant,has no plans to <br /> subdivide the subject property in the near term, the applicant would like to <br /> • have the existing 18-foot wide paved road be deemed sufficient (as if the use <br /> were allowed via a Special Permit); <br /> ® have any required water system be determined in conjunction the building <br /> permit process by the Fire Department; and <br />
