BKe`AlohaLaniLLCREZ-7/8/22 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> KE`ALOHA LANI, LLC <br /> CHANGE OF ZONE APPLICATION(PL-REZ-2022-000023) <br /> KE`ALOHA LANI, LLC has submitted an application for amendments to Condition E (Timing <br /> of Fire Flow Improvements) and Condition I (Timing of Roadway Improvements) of Ordinance <br /> No. 17-65 which reclassified 6.505 acres of land from an Agricultural-20 acres (A-20a) to a <br /> General Industrial-20,000 square feet (MG-20) zoning district. The applicant is requesting these <br /> amendments to change the development trigger for these required improvements from prior to <br /> issuance of Certificate of Occupancy to prior to Final Subdivision Approval. The subject <br /> property is located east of Highway 11 (Volcano Highway), west of Railroad Avenue, and north <br /> of Highway 130 (Kea`au-Pahoa Highway), Kea'au, Puna, Hawai`i, TMK: (3) 1-6-141:002. <br /> PROPOSED ACTION <br /> 1. Applicant's Request: The applicant, Ke `Aloha Lani LLC, has submitted an application <br /> to amend conditions of Change of Zone Ordinance No. 17-065, which was originally <br /> approved on September 29, 2017 to change the zoning from an Agricultural (A-20a) to <br /> General Industrial (MG-20) zoning district for 6.505 acres of land. Concurrently, <br /> Ordinance No. 17-064 was approved to change the State Land Use Boundary designation <br /> from Agricultural to Urban. <br /> As the subject ordinance has infrastructure obligation conditions that the applicant <br /> has not met or reasonably fulfilled, the applicant is requesting to amend certain <br /> conditions of the ordinance, specifically Condition E and I of Change of Zone Ordinance <br /> No. 17-065. These amendments are to the following conditions: <br /> • Condition E: (Timing of Fire Flow Improvements) <br /> • Condition I: (Timing of Roadway Improvements) <br /> The following are the specific amendment requests (material to be deleted is <br /> bracketed/struck through, material to be added is underscored: <br /> Amend Condition E: <br /> "Prior to receipt of[a Certificate of Occupancy]Final Subdivision Approval, the <br /> -1- <br />
