KEKAI: Um', yeah, so, this is rezone applications right in ordinances.— <br /> AGUINALDO: Yeah. <br /> KEKAI: — so the Council is the ultimate authority like you pass recommendations— <br /> AGUINALDO: Yes, yes. <br /> KEKAI: —the Director passes recommendations. <br /> AGUINALDO: Yes. <br /> KEKAI: — So, initially yeah, the Director does not have the authority to just pass a zone <br /> change on his own. It has to go through Council— <br /> AGUINALDO: Oh, so, okay. <br /> KEKAI: So, this as, Holeka pointed out this already occurs actually with language, you <br /> know, the Council does approve time,technically administrative time extensionswhen it's <br /> included in an ordinance, right. So, the Council does have the authority to do that. <br /> AGUINALDO: Oh, so they don't work with Director Kern on that? <br /> KEKAI: I wouldn't say they don't work with the Directors; I think that there is a full <br /> discussion at Council, and it is fully vetted out and but at the end of the day the Council has the <br /> ultimate authority whether to approve the recommended conditions or not. <br /> AGUINALDO: Oh, okay. <br /> KEKAI: Yep. <br /> AGUINALDO: Okay. Thank you. <br /> LIN: Go ahead Councilman. <br /> INABA: One more thing,just on the language. I know you the represent the Commission <br /> but I'm not sure what the appropriate action is. Whether to like have the proposed changes to <br /> this language now or advance it with the understood intention? <br /> KEKAI: Um' I think either way, I mean this is basically the Commission would be a <br /> recommendation right, so they could say we recommend the following language. So, it's really <br /> up to the Commission on how they want to do it, if they want to pass it through here with the <br /> record and just say, you've heard what we had to say or not. Yep.
