COUNTY OF HAWAII STATE OF HAWAII <br />RESOLUTION NO. 337 23 <br />A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL <br />RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO <br />THE FRIENDS OF AMY H.H. GREENWELL ETHNOHOTANICAL GARDEN. <br />WHEREAS, Section 10-15 of the I-lawai'i County Charter provides for a Public Access, <br />Open Space, and Natural Resources Preservation Fund to acquire lands and easements in the <br />County of Hawaii for public outdoor recreation, education, and preservation of coastal areas; <br />and <br />WHEREAS, Section 10-I6 of the Hawaii County Charter establishes a Public Access, <br />Open Space, and Natural Resources Preservation Maintenance Fund (hereinafter "Maintenance <br />Fund") to preserve these lands, promote public safety, and maintain a healthy stewardship; and <br />WHEREAS, Section 10-16(h) of the Ilawai'i County Charter provides that the <br />Maintenance Fund may be used for a stewardship grant program for properties purchased via the <br />Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 <br />nonprofit organizations to apply for grant-in-aid project funding for steward projects; and <br />WHEREAS, the Friends of the Amy B. II. Greenwell Ethnobotanical Garden is a <br />501(e)3 nonprofit organization whose mission is to support Hawaiian cultural traditions of land <br />use and plants and conserving the plant resources of traditional Hawaiian cultural activities as <br />well as to ensure the continuance of this national treasure as an ethnobotanical garden: and <br />WHEREAS, the Friends of Amy B.I-l. Greenwell Gthnobotanical Garden has submitted a <br />Maintenance Fund stewardship grant application to continue providing land stewardship and <br />cultural education for the properties situated in Kealakekua. District of South Kona (TMK: (3) <br />8-2-013:001003, 014; 8-2-014:043 and 8-2-015:059), which were acquired via the Public <br />Access, Open Space, and Natural Resources Preservation Fund after adoption of Resolution No. <br />155-19: and <br />WHEREAS, during its September 12, 2022, meeting, and pursuant to Section 2-217 of <br />the Hawaii County Code 1983 (2016 Edition, as amended), the Public Access, Open Space, and <br />Natural Resources Preservation Commission forwarded a positive recommendation for this <br />project to the Director of Finance; and <br />WHEREAS, Communication No. 336. 1, issued by the Director of Finance on September <br />19, 2023, submitted for the Council's consideration four applicants for stewardship grants for <br />various properties that have been acquired by the County using the Public Access, Open Space, <br />and Natural Resources Preservation fund; and <br />WHEREAS, in Communication No. 336. 1, the Director of Finance's recommendation is <br />that the Friends of Amy B.H. Greenwell Etlmobotanical Garden will be able to complete its <br />project in accordance with the project description submitted and in strict adherence to the <br />conditions governing the Public Access, Open Space, and Natural Resources Preservation <br />Maintenance Fund; and <br />
