C,` <br /> COUNTY OF HAWAI`I -• � %�• STATE OF HAWAI`I <br /> RESOLUTION NO. 355 23 <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br /> INTERGOVERNMENTAL AGREEMENT WITH THE DEPARTMENT OF HAWAIIAN <br /> HOME LANDS REGARDING MAINTENANCE AND IMPROVEMENT OF COUNTY <br /> MAINTAINED ROADS IN KEAUKAHA. <br /> WHEREAS, Hawai`i Revised Statutes Section 46-7 requires the County of Hawai'i to <br /> obtain consent of the Council to enter into agreements with the federal or state governments, <br /> respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, <br /> and receive any funds or other assistance in connection with projects being or to be undertaken <br /> pursuant to those powers; and <br /> WHEREAS, Section 220 of the Hawaiian Homes Commission Act mandates that roads <br /> running through or over Hawaiian home lands shall be maintained by the County in which the <br /> roads are located; therefore, the County of Hawai'i is responsible for the maintenance of roads <br /> located on Hawaiian home lands in Keaukaha; and <br /> WHEREAS,the Department of Public Works ("County") and the Department of <br /> Hawaiian Home Lands ("DHHL") desire to enter into a Memorandum of Agreement for paving, <br /> widening, and drainage improvements for certain roads located in Keaukaha("Project"); the <br /> Agreement requires DHHL to secure all necessary permits and approvals, and provide payment <br /> to the County for Project materials, while the County will provide the necessary equipment and <br /> labor; now,therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that in <br /> accordance with Hawai`i Revised Statutes Section 46-7, the Mayor of the County of Hawai`i is <br /> authorized to execute, on behalf of the County, an intergovernmental agreement with the <br />
