if Facts, Conclusions of Law, and Decision and Order; and the <br />entire record of this docket, hereby makes the following findings <br />of fact, conclusions of law, and proposed decision and order: <br />MMNWITMTMVRF�� <br />1. Peoner is a department of the County • Hawaii <br />whose business and mailing address is 25 Aupuni Street, Hilo, <br />Hawaii 96720. <br />2. On June 28, 1994, Petitioner filed a Petition for <br />Land Use District Boundary Amendment ("Petition") with the <br />Commission. The Petition requested reclassification of <br />approximately 2,940.39 acres of land within the land divisions of <br />Kau to Keauhou, North Kona District, Island and County of Hawaii, <br />State of Hawaii from the Agricultural District to the Urban <br />District. <br />3. • July 18, 1994, the Executive • • the <br />Commission determined that the Petition was defective since a <br />metes and bounds description and map of the initial Petition Area <br />and written authorization from a number of the affected <br />landowners were not obtained. <br />4. On August 30, 1994, Petitioner filed its Amended <br />Petition with the Commission. The Amended Petition requested <br />reclassification of approximately 3,017 acres of land from the <br />Agricultural to the Urban District within the land divisions of <br />Kau to Keauhou, North Kona District, Island and County of Hawaii, <br />State of Hawaii. The increase in acreage was due to the addition <br />of parcels identified as TMK: 7-5-10: 5, and 7-7-04: 56. <br />CM <br />
