COUNTY OF HAWAI`I -- �'- ' ��• STATE OF HAWAPI <br /> ........ .............. <br /> RESOLUTION NO. 485 24 <br /> A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A ONE YEAR <br /> INTERGOVERNMENTAL AGREEMENT WITH THE UNIVERSITY OF HAWAI`I AND <br /> THE STATE OF HAWAI`I FOR A RADIO REPEATER SITE. <br /> WHEREAS, Hawai`i Revised Statutes Section 46-7 requires that County departments <br /> obtain the consent of the Council to enter into agreements with the federal or state governments <br /> respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, <br /> and receive any funds or other assistance in connection with projects being or to be undertaken <br /> pursuant to those powers; and <br /> WHEREAS,the Hawai`i County Charter Section 10-11 requires that any contract, lease <br /> or other obligation requiring payment of funds from the appropriations of a later fiscal year or of <br /> more than one fiscal year be approved by resolution; and <br /> WHEREAS,the Hawai`i County Civil Defense Agency wishes to enter into a Non- <br /> Exclusive License Agreement with the University of Hawai`i, a public body corporate and the <br /> public Licensor of the State of Hawai`i to install an amateur radio repeater on the summit of <br /> Mauna Kea for the purpose of an island-wide community emergency radio communications <br /> network to facilitate the Hawai`i County Auxiliary Communications Service; and <br /> WHEREAS, this one (1)year License Agreement will support the Hawai`i County Civil <br /> Defense Agency's desire to supplement its connectivity for the Island of Hawai`i by installing a <br /> radio repeater within a portion of the astronomy facility known as the University of Hawai`i 2.2- <br /> meter Telescope Utility Building; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: that in <br /> accordance with Hawai`i Revised Statutes Section 46-7, and the Hawai`i County Charter Section <br />
