REQUEST: <br /> The Department of Environmental Management ("DEM") requests the placement of the attached draft <br /> resolution on the May 15, 2024 Council agenda,waiving Committee, The attached draft resolution requests <br /> authorization to purchase the Waiea Transfer Station through a condemnation action, due to title defects <br /> affecting the property, <br /> B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): <br /> Purchase of the Waiea Transfer Station site TMK No. (3)8-6-008:011 is an integral part of the Department's <br /> plans. Funds equivalent to the fair market value of the property were included in the budget of the current <br /> fiscal yeaati0T_he department obtained an independent appraisal of the property, which is valued at Two <br /> Hundrectan o y-thven Dollars ($247,000.00). Negotiations were initiated with one of the owners of the <br /> property, but there are other owners of record, who cannot be located. The real estate broker representing <br /> one of the owners recommended purchase via a quit claim'deed. This is not an acceptable risk for the <br /> county. Initiating a condemnation action in accordance with Section 101-26 Hawai'i Revised Statutes will <br /> ensure that the County obtains clear title. County Council approval is required to initiate a condemnation <br /> action.
