NO . <br /> 105 (1) Operating or capital costs of public <br /> 106 transportation within each county for public transportation <br /> 107 systems, including: <br /> 108 (A) Public roadways or highways; <br /> 109 (B) Public buses; <br /> 110 (C) Trains; <br /> 111 (D) Ferries; <br /> 112 (E) Pedestrian paths or sidewalks; or <br /> 113 (F) Bicycle paths; <br /> 114 (2) Expenses in complying with the Americans with <br /> 115 Disabilities Act of 1990 with respect to paragraph (1) ; and <br /> 116 (3) Housing infrastructure; provided that a county <br /> 117 that uses surcharge revenues for housing infrastructure shall <br /> 118 not pass on those housing infrastructure costs to the developer <br /> 119 of a housing project; provided further that this paragraph shall <br /> 120 apply only if a county amended its surcharge ordinance pursuant <br /> 121 to subsection (d) or adopts a county surcharge on state tax <br /> 122 ordinance after December 31, 2022; provided that each county <br /> 123 having a population equal to or less than five hundred thousand <br /> 124 that adopts a county surcharge on state tax ordinance pursuant <br /> 125 to this section after December 31, 2022,- shall use the surcharge <br /> xXX-00 <br />
