Heather Kimball, Council Chair <br />and Members of the County Council <br />County of Hawaii <br />October 22, 2024 <br />Page 4 <br />applicant provided comments noting that the water calculations and required <br />improvements, if necessary, will be done in conjunction with the plan approval and <br />building permitting process. <br />To facilitate DWS review of the required water usage calculations, the Planning <br />Director is recommending amending Condition D to specify that updated water <br />calculations shall be submitted within 1.80 days of the effective date of amended <br />ordinance and to address potential improvements as noted by DWS. <br />There is no municipal sewer system in the area, thus an individual wastewater <br />system meeting with the approval of the State Department of Health will be utilized. <br />There are no municipal solid waste collection services in the County. Solid waste <br />will be disposed of at an authorized landfill by commercial haulers or by the landowner. <br />The request is not contrary to Chapter 205A, Hawaii Revised Statutes, <br />relating to Coastal Zone Management. The project site is located approximately 5.5 <br />miles from the nearest shoreline and is not situated within the SMA. Thus, the property <br />will not be affected by coastal hazards and beach erosion. There are no identified <br />recreational resources, historic resources, public access to the shoreline or mountain <br />areas, scenic and open space preserves, coastal ecosystems, or marine resources on the <br />subject property. <br />In view of the Hawaii State Supreme Court's PASH and "Ka Pa`akai O Ka`aina" <br />decisions, the issue relative to native Hawaiian gathering and fishing rights must be <br />addressed in terms of the cultural, historical, and natural resources and the associated <br />traditional and customary practices of the site: <br />Investigation of valued resources: No professional archaeological and cultural <br />study was conducted as the subject property has been cleared and impacted by residential <br />development. According to comments from the State Department of Land and Natural <br />Resources, State Historic Preservation Division (SHPD), the project area has been <br />impacted by ground -disturbing activities, no archaeological inventory survey has been <br />conducted and no historic properties have been identified previously in the project area, <br />therefore the determination is "no historic properties affected." <br />The valued cultural, historical, and natural resources found in the rezoning area: <br />As mentioned above, SHPD determined that no historic properties would be affected and <br />the property has been cleared and impacted by residential development. <br />
