Project that meets the requirements of the U.S. <br /> Environmental Protection Agency's 40 CFR Part 6, <br /> Subpart E and 40 CFR sec. 35.3140. <br /> c. Affirm that the Project is consistent with <br /> plans developed under 33 U.S.C. sections 1285(j), 1288, <br /> 1313(e), 1329, and 1330. <br /> d. Adopt and maintain a user charge system and <br /> sewer use ordinance for the useful life of the Project. <br /> The user charge system and sewer use ordinance shall <br /> comply with the requirements of^:40"`CFR sec. 35.2122 and <br /> shall be reviewed and approved by the DIRECTOR <br /> annually. The COUNTY is deemed the "applicant" and the <br /> DIRECTOR is deemed the "Regional Administrator" for the <br /> application here of this federal regulation. <br /> e. Submit a final operation and maintenance <br /> manual to the DIRECTOR for approval .prior to ninety <br /> percent (90~) of Project completion. <br /> f. Comply with the Davis-Bacon labor wage <br /> provisions to treatment works construction. Wages paid <br /> for the construction of treatment works must conform to <br /> the prevailing wage rates established for the locality <br /> by the U.S. Department of Labor under Section 513 of <br /> the Davis-Bacon Act, 46 Stat. 1494, 40 U.S.C.A. secs. <br /> 276a - 276a-5 (West 1986). <br /> 20. LOBBYING. No portion of this loan shall be used <br /> for lobbying or propaganda purposes as prohibited by 18 U.S.C.A. <br /> <br /> ADM. SERV. OFFICE <br /> LOG NO. 91-178 17 <br /> <br />
