~ <br /> <br /> HEALTH as required by this Agreement or defaults in the <br /> observance or performance of any other provisions of this <br /> Agreement, the DIRECTOR shall be entitled to an order or a writ <br /> of mandamus issued by a court of proper jurisdiction, compelling <br /> and requiring the COUNTY and its officers to observe and perform <br /> any covenant, condition or obligation prescribed in this <br /> Agreement. <br /> No delay or omission to exercise any right or power <br /> shall be construed to be a waiver of any such default or <br /> acquiescence therein, and every such right and power may be <br /> exercised from time to time and as often as may be deemed <br /> expedient. The specific remedy herein provided shall be <br /> cumulative of all other existing remedies and the specification <br /> of such remedy shall not be deemed to be exclusive. <br /> 13. USER CHARGE SYSTEM The COUNTY shall at all times <br /> maintain a User Charge System designed to produce adequate <br /> revenue required for operation and maintenance (including <br /> replacement) in accordance with 40'CFR sec.-35:2i~4`0' (the COUNTY <br /> is deemed the "grantee" and the DIRECTOR is deemed the "Regional <br /> Administrator" for the application here of this federal <br /> regulation). <br /> The User Charge System may include ad valorem taxes, <br /> user charges based on actual use, or other sources of income <br /> which are consistent with federal requirements. <br /> The COUNTY guarantees that revenues from the User <br /> ADM.
