No. 38/Bill No. 10 <br />PLACE: Council Chambers <br />Kailua-Kona, Hawaii <br />TIME: 11:53 a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Policy Committee on Public Works and Mass Transit, to which was referred Bill No. 10, <br />reports as follows: <br />Bill No. 10, introduced by Council Chairperson. Dr. Holeka Goro Inaba, via Communication <br />No. 38, dated November 25, 2024, amends Chapter 22, Article 3, Division 2, Section 22-3.3.2, of <br />the Hawaii County Code 1983 (2016 Edition, as amended), relating to allowable areas for <br />special activity permits. <br />Bill No. 10 proposed to allow for authorized commercial activities to be conducted at Ane <br />Keohokalole Highway, makai side, between Palani Road and Kealakehe Parkway in Kona. <br />Policy Committee on Public Works and Mass Transit Meeting of January 21, 2025 <br />Council Chairperson Inaba explained that Bill 10 inserts a portion of the Ane Keohokalole <br />Highway, specifically from the southern point of Kealakehe Parkway, to fall in line with the <br />process set forth in the County Code for where authorized commercial activities may take place. <br />Pursuant to Section 22-3.3.1 of the County Code, the Committee referred Bill 10 to the Chief of <br />Police and Director of Public Works for their respective recommendations. <br />Council Member Heather Kimball sought clarity on which entity is responsible for drafting and <br />submitting the request for recommendations to departments and suggested that it should be the <br />introducer. Council Chairperson agreed and indicated that his office would handle the request. <br />Bill 10 was postponed to February 18, 2025, with eight "ayes", with Committee Member Matt <br />Kaneali`i-Kleinfelder absent. <br />Policy Committee on Public Works and Mass Transit Meeting of February 18, 2025 <br />Council Chairperson Inaba advised the Committee that he met with representatives of the <br />Hawaii Police Department and Department of Public Works, separately then together, and <br />worked on an agreed -upon amendment that resulted in the transmittal of Communication. 38.1. <br />The amendment adjusts the area within which authorized commercial activities would be <br />allowed at Ane Keohokalole Highway between the West Hawaii Civic Center and the "Allied <br />Quarry" access road. <br />PCPWMT Report No. 2 <br />
