Page 41 <br />I official capacity, for any claim for damage to or loss <br />2 of property or personal injury or other civil liability <br />3 caused by or arising out of any actual or alleged act, <br />4 error or omission that occurred, or that the person <br />5 against whom the claim is made had a reasonable basis <br />6 for believing occurred within the scope of Commission <br />7 employment, duties or responsibilities; provided that <br />9 nothing in this paragraph shall be construed to protect <br />9 any such person from suit and/or liability for any <br />10 damage, loss, injury or liability caused by the <br />11 intentional or willful or wanton misconduct of that <br />12 person; <br />13 2. The Commission shall defend any member, officer, <br />14 Executive Director, employee or representative of the <br />15 Commission in any civil action seeking to impose <br />16 liability arising out of any actual or alleged act, <br />17 error or omission that occurred within the scope of <br />is Commission employment, duties or responsibilities, or <br />19 that the person against whom the claim is made had a <br />20 reasonable basis for believing occurred within the scope <br />21 of Commission employment, duties or responsibilities; <br />22 provided that nothing herein shall be construed to <br />R&MI =..* 0 <br />
