Page 51 <br />I <br />arise among Compact States and between Compact and Non- <br />2 <br />Compact States; and <br />3 <br />2. <br />The Commission shall promulgate a rule providing for <br />4 <br />both mediation and binding dispute resolution for <br />5 <br />disputes that arise before the Commission. <br />6 <br />D. <br />Enforcement: <br />7 <br />1. <br />The Commission, in the reasonable exercise of its <br />8 <br />discretion, shall enforce the provisions and Rules of <br />9 <br />this Compact; <br />10 <br />2. <br />By majority vote, the Commission may initiate legal <br />11 <br />action in the United States District Court for the State <br />12 <br />of Georgia or the federal district where the Compact has <br />13 <br />its principal offices against a Compact State in default <br />14 <br />to enforce compliance with the provisions of the Compact <br />is <br />and its promulgated Rules and Bylaws. The relief sought <br />16 <br />may include both injunctive relief and damages. In the <br />17 <br />event judicial enforcement is necessary, the prevailing <br />is <br />member shall be awarded all costs of such litigation, <br />19 <br />including reasonable attorney's fees; and <br />20 <br />3. <br />The remedies herein shall not be the exclusive remedies <br />21 <br />of the Commission. The Commission may pursue any other <br />22 <br />remedies available under federal or state law. <br />
