g) Management of Access: Required. Permittee shall manage the <br />use of the improved access road as an emergency thoroughfare <br />to allow for safe passage of 2WD vehicles and minimizing <br />unauthorized use of surrounding Property by conducting the <br />following: <br />1. Establish and post speed limit signs. <br />2. Install and maintain "No Trespassing", "Private <br />Property" or similar signs along the road to discourage <br />roadway users from entering or accessing surrounding <br />Property. <br />J. Install and maintain gates upon KS demand and/or <br />approval of gate design. <br />4. Keep gates locked when road is not in use as an <br />emergency thoroughfare. <br />h) Notice of Entry by Authorized Persons. Section 4(b) of the <br />General Provisions (Exhibit B) of this Agreement is amended <br />in its entirety to read as follows: <br />(b) Prior Notice of Each Entry. <br />(i) Except in the event of an emergency, Permittee shall <br />provide Owner not less than 48 hours prior written notice of <br />each entry onto the Property, together with a list of the names <br />of the Authorized Persons who will be entering the Property, <br />the specific purpose for the entry, and an estimate of the <br />anticipated duration of the entry (which duration shall not <br />exceed thirty (30) days). If any Authorized Persons are <br />Permittee's Contractors, Permittee will also provide Owner <br />with its written proposed entry plan to include dates, times, <br />and the purpose(s) of the entry, the Permitted Contractors' <br />agreement to indemnify Owner as required in Section 6(c) of <br />the General Provisions (Exhibit B) of this Agreement, and <br />copies of the Permittee's Contractors' insurance policies for <br />review and approval by Owner, it being acknowledged and <br />agreed that the Permittee's Contractors' liability insurance <br />shall have at least the Minimum Coverage Limits set forth in <br />Section 60) of the Special Terms of this Agreement.
