g) Management of Access: Required. Permittee shall manage the use of the improved access road as an emergency thoroughfare to allow for safe passage of 2WD vehicles and minimizing unauthorized use of surrounding Property by conducting the following: 1. Establish and post speed limit signs. 2. Install and maintain "No Trespassing", "Private Property" or similar signs along the road to discourage roadway users from entering or accessing surrounding Property. J. Install and maintain gates upon KS demand and/or approval of gate design. 4. Keep gates locked when road is not in use as an emergency thoroughfare. h) Notice of Entry by Authorized Persons. Section 4(b) of the General Provisions (Exhibit B) of this Agreement is amended in its entirety to read as follows: (b) Prior Notice of Each Entry. (i) Except in the event of an emergency, Permittee shall provide Owner not less than 48 hours prior written notice of each entry onto the Property, together with a list of the names of the Authorized Persons who will be entering the Property, the specific purpose for the entry, and an estimate of the anticipated duration of the entry (which duration shall not exceed thirty (30) days). If any Authorized Persons are Permittee's Contractors, Permittee will also provide Owner with its written proposed entry plan to include dates, times, and the purpose(s) of the entry, the Permitted Contractors' agreement to indemnify Owner as required in Section 6(c) of the General Provisions (Exhibit B) of this Agreement, and copies of the Permittee's Contractors' insurance policies for review and approval by Owner, it being acknowledged and agreed that the Permittee's Contractors' liability insurance shall have at least the Minimum Coverage Limits set forth in Section 60) of the Special Terms of this Agreement.
