<br /> April 6,2005—The County Council adopted Ordinance No. 05-50, and applicant Continental
<br /> Pacific, LLC agreed to submit the applicable public access easement or declaration documents to
<br /> the Planning Director for recordation at the Bureau of Conveyances within 180 days of the
<br /> effective date of the ordinance, and to provide one (1) additional public vehicular access and a
<br /> parking area sufficient for a minimum of four(4) vehicles at the location south of the former
<br /> Pepe`ekeo Mill Site in the approximate area known as Iron Post.
<br /> September 12,2006 - Continental Pacific, LLC recorded a Declaration of Vehicular Public
<br /> Access Easements with the State of Hawaii Bureau of Conveyances as Document No. 2006-
<br /> 167460, in which Continental declared perpetual non-exclusive easements for vehicular public
<br /> access relating to portions of TMK Nos. (3) 2-8-08:03, 41, 95 and 110, under Subdivision No.
<br /> 7644-Revised(2) and TMK(3) 2-8-07:85, of which the County of Hawaii has no responsibility
<br /> for maintenance.
<br /> December 11,2008 - Continental Pacific, LLC recorded an Amended and Restated Declaration
<br /> of Vehicular and Parking Public Access Easements with the State of Hawaii Bureau of
<br /> Conveyances as Document No. 2008-186339, in which Continental declared perpetual non-
<br /> exclusive easements for vehicular and parking public access relating to portions of TMK Nos.
<br /> (3) 2-8-008:95, 100, 110, 125 and 126,under Subdivision No. 7644-Revised(2) and TMK(3)2-
<br /> 8-07:85, of which the County of Hawaii has no responsibility for maintenance.
<br /> June 17,2011- Continental Pacific, LLC recorded a Second Amended and Restated Declaration
<br /> of Vehicular and Parking Public Access Easements with the State of Hawaii Bureau of
<br /> Conveyances as Document No. 2011-095621, adding an additional vehicular and parking
<br /> easements, of which the County of Hawaii has no responsibility for maintenance.
<br /> August 17,2011 -Resolution No. 109-11 was adopted and the County accepted a Grant of
<br /> Public Access Easement recorded with the State of Hawaii Bureau of Conveyances as
<br /> Document No. 2011-136099 on August 25, 2011, affecting Tax Map Keys (3) 2-8-008:003, 041,
<br /> 100, 129, 135, and 149 through 158, inclusive, situated in Kapehu, Kaupakuea, Kahua, and
<br /> Makahanaloa, District of South Hilo, County and State of Hawaii,that identifies the easements
<br /> the County holds responsibility for maintenance, which includes:
<br /> "Pedestrian Public Access:
<br /> Easement P-I for pedestrian public access purposes (containing a total area of 0.165
<br /> acre) affecting Lot 7041, being further identified as TMK(3) 2-8-008:003, as more
<br /> particularly described in Exhibit and depicted on Exhibits I and I-A;
<br /> Easement P-2 for pedestrian public access (containing a total area of 0.196 acre)
<br /> affecting Lot 7, being further identified as TMK(3) 2-8-008:041, as more particularly
<br /> described in Exhibit B and depicted on Exhibits I and 1-A;
