NOW, THEREFORE, Grantor and Grantee agree as follows: THAT THE Grantor, for and in consideration of the sum of TEN AND NOI100 DOLLARS ($10.00) paid by Grantee, the receipt whereof is hereby acknowledged, and in further consideration of the covenants and conditions herein contained by Grantee to be observed and performed, does hereby bargain, sell, assign and grant unto the said Grantee, and its successors and assigns, perpetual and nonexclusive right and easement in, upon, through, over, under and across the Grantor's Property for pedestrian public access purposes as indicated thereon, including without limitation, the construction, reconstruction, installation, maintenance, operation, replacement and repair of improvements constructed for said purposes (collectively "Public Access Easements"), as follows: Pedestrian Public Access 1. Easement P-1 for pedestrian public access purposes (containing a total area of 0.165 acre) affecting Lot 70-1-1, being further identified as TMK: (3) 2-8-008:003, as more particularly described in Exhibit A and depicted on Exhibits 1 and 1-A, attached hereto and incorporated by reference herein; 2. Easement P-2 for pedestrian public access purposes (containing a total area of 0.196 acre) affecting Lot 7, being further identified as TMK:(3) 2-8-008:041, as more particularly described in Exhibit B and depicted on Exhibits 1 and 1-A, attached hereto and incorporated by reference herein; 3. Easement P-6 for lateral pedestrian public access and parking purposes (containing a total area of 0.25 acre) affecting Lot 23, being further identified as TMK:(3) 2-8-008:151, as more particularly described in Exhibit C and depicted on Exhibits 1 and 1-B, attached hereto and incorporated by reference herein; 4. Easement P-6-A for lateral pedestrian public access purposes (containing a total area of 16,800 square feet) affecting Lot 22, being further identified as TMK:(3) 2-8.008:150, as more particularly described in Exhibit D and depicted on Exhibits 1,1-8 and 1-D, attached hereto and incorporated by reference herein; 5. Easement P-6-8 for lateral pedestrian public access purposes (containing a total area of 33,373 square feet) affecting Lot 21, being further identified as TMK:(3) 2-8-008:149, as more particularly described in Exhibit E and depicted on Exhibits 1,1-B and 1-E, attached hereto and incorporated by reference herein; -4-
