COUNTY OF HAWAI`I • STATE OF HAWAI`I <br />RESOLUTION NO. 51-8 26 <br />A RESOLUTION AMENDING THE RULES OF PROCEDURE AND ORGANIZATION <br />OF THE COUNCIL OF THE COUNTY OF HAWAI`I BY REPEALING RULE NO.7 <br />AND ADDING A RULE RELATING TO PERMITTED INTERACTION GROUPS. <br />WHEREAS, on December 2, 2024, the Council of the County of Hawaii (hereinafter, <br />the "Council") adopted the Rules of Procedure and Organization of the Council of the County of <br />Hawaii (hereinafter, the "Rules") as provided in Resolution No. 3-25 to govern the affairs of the <br />Council; and <br />WHEREAS, Rule No. 16-1 provides, in part, that the Rules "may be amended at a <br />regular Council meeting by a resolution approved by an affirmative majority vote of the entire <br />membership of the Council"; and <br />WHEREAS, the Council finds that Rule No. 7 bears further consideration and <br />clarification; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that <br />Rule No. 7 of the Rules is hereby substituted with the following: <br />"RULE NO.7 <br />PERMITTED INTERACTION GROUPS <br />1. Establishment. A permitted interaction group may be established only by the <br />affirmative vote of a majority of the entire membership of the Council or a Standing <br />Committee at a duly noticed meeting, in accordance with these rules and applicable <br />law. The motion establishing the permitted interaction group shall: <br />(a) Define the scope of the investigation or assignment and the authority of the <br />permitted interaction group; and <br />(b) Identify the Chairperson and members of the permitted interaction group. <br />2. Membership. A permitted interaction group shall consist of no fewer than two (2) <br />and no more than four (4) members of the Council or a Standing Committee. <br />3. Findings and Recommendations. All findings, reports, and recommendations shall <br />be presented at a duly noticed meeting of the Council or Standing Committee that <br />established the permitted interaction group. <br />4. Deliberation and Decision -Making. Deliberation and decision -making on an <br />investigated matter shall occur only at a duly noticed meeting held after the meeting <br />in which the findings and recommendations of investigations were presented to the <br />Council or Standing Committee. <br />5. Compliance with Law. All permitted interaction groups shall be conducted in strict <br />compliance with Chapter 92, Hawai'i Revised Statutes." <br />
