The Department does have some concerns to the request. <br /> Normally, in a aon-exclusive easement, the Department would provide ~~++1n1a1 maintenance of the <br /> roadway merely for access for purposes of maintauring and operating the water system facilities within <br /> the easement and within sites that wLll be along the easement. Will the Council provide for <br /> maintenance of the access roadway and easement to insure the safety of the users? Will the Council <br /> assume liability for the users of the easement <br /> Further, opening the easement to the public increases the potential for vandalism to the utility systems <br /> in a remote area.
