Arakaki, Chairman <br /> and Members of the County Council <br /> County of Hawaii <br /> 25 Aupuni Street <br /> Hilo, HI 96720 <br /> Dear Chairman Arakaki and Members: <br /> Change of Zone Ordinance No. 00-105 Which Amended Ordinances 99-79 <br /> and 94-78 (REZ 767) <br /> Request: Amendment to Condition C (Secure Final Subdivision Approval) <br /> Applicant: Big Island Country Club & Estates <br /> Tax Man Kev• 7-1-5.9¢10, 22326 283343.9-4158 & 59 <br /> The Planning Commission, after a duly held public hearing on May 4, 2001, voted to recommend <br /> for your approval the proposed legislative bill to amend Condition M and M(2) (commence and <br /> complete construction of community park, recreational center and fire station facilities) of <br /> Change of Zone Ordinance No. 00-105 which amended Ordinance Nos. 99-79 and 94-78, which <br /> changed the district classification of approximately 425.69 acres of land from Unplanned (U) to <br /> Agricultural (A-la). The property is located on the northwest (makai) side of Mamalahoa <br /> Highway opposite the Puu Lani Ranch Subdivision at Pu`uanahulu Homesteads, North Kona, <br /> Hawaii. <br /> The Commission concurs with the following Planning Director's reasons for recommending <br /> favorable consideration of the request: <br /> The purpose of this request is to amend the performance requirements of <br /> Ordinance No. 00-105, which amended Ordinance Nos. 99-79 and 94-78 (REZ 767) is to <br /> ensure that the applicant is not in violation of the time conditions. The inability of the <br /> applicant to comply with the requirements of Condition M and M(2) of Change of Zone <br /> Ordinance No. 00-105 which amended Ordinance Nos. 99-79 and 94-78 (REZ 767) is the <br /> result of conditions which could not have been foreseen or are beyond the control of the <br /> applicant. The applicant completed construction plans for the community center, secured <br /> plan approval and submitted a building permit application for the recreational center last <br /> <br />
